Court won't reinstate New York City's big-soda ban

That's right. The Bloomberg nanny state intrusion, however well intentioned, is dead. Long live personal freedoms.

The state's Court of Appeals ruled Thursday that the city's health department overstepped its bounds when it restricted the size of sodas.

The court is siding with a lower court that overturned the 2012 ban. The city had hoped Thursday's ruling would reinstate the restrictions, which banned the sale of sugary drinks larger than 16 ounces.

Pushed by then-Mayor Michael Bloomberg as a way to fight obesity and other health conditions, the limits would apply to restaurants, delis, movie theaters, stadiums and street carts.
Restaurants, theater owners and beverage companies sued. They argued that New York City didn't have the authority to impose the ban. Court won't reinstate New York City's big-soda ban

Government assuming it has the authority to do whatever it pleases seems to be contracting. NYC being the testing grounds for such legislation was dealt a blow, and I think that's a good thing.
“I think if Thomas Jefferson were looking down, the author of the Bill of Rights, on what’s being proposed here, he’d agree with it. He would agree that the First Amendment cannot be absolute.” - Chuck Schumer (D). Yet, Madison and Mason wrote the Bill of Rights, according to Sheila Jackson Lee, 400 years ago. Yup, it's a fact.

Obviously this court was paid for by the "Big HFCS" cabal, Diabetes Drug Companies and basically hates people. Without this ban, however will New Yorkers control themselves? However will they keep from drinking or eating too much?

Obviously there is shinnanigans going on and Obama should just pick up his pen and call the state of NY and tell them "it is so".
Climate, changes. It takes a particularly uneducated population to buy into the idea that it's their fault climate is changing and further political solutions can fix it.

Some **** just shouldn't even have to go to court. **** like this, or like a case just decided by the Supreme Court concerning police officers needing a warrant or not to search your cell phone. Do you think judges sometimes sit there and think "WTF....why is this even making all the way to MY desk?".

Bloomberg's nanny statism is annoying beyond belief, starkly resembles prohibition, and is one of the least effective ways to reduce obesity. Good news.

Glad the badn is lifted.... Bloomberg was the WORST Left-Winged nanny state nutjob we've had running a big blue city in a while (Sorry Rahm.... you are gonna have to be runner-up). Glad SCONY (Supreme Court of New York) did a good job overturning this ruling although I have a question... what would have stopped me from buying a giant re-usable to-go container and then just filling it up with multiple sodas?
