    It's obvious just by looking at him that this is his every-day wear. He's grown out and highlighted his hair. His eyebrows are shaped.     He states himself as a boy who is gender non-conforming. The correct pronoun is "he," which his mother uses as well. This is quite simple.

    There is no reason to refer to someone as "it" unless you are being intentionally insulting. If you are truly totally stumped about someone's gender, "they" is an option which doesn't refer to someone as an object, and you know this.
    I guess you didn't read the part where I did use "they". If you/yunz/y'all don't like he/she/it, then feel free to be insulted.

    Show me the law that says a person identified as "male" on their license cannot dress in what is typically considered female clothing, wear what is typically considered female hairstyles or jewelry, or wear makeup in a way that typically females wear it.

    Not if the rules are discriminatory. In reality though, this wasn't about the rules at all because from a reasonable person POV, what this boy was wearing was not a disguise, but his normal attire. It was simply not what most boys wear, but many girls do. And that was the problem, the adult government workers here wanted to impose their personal views on what males and females should or should not wear on this boy, which is gender/sex discrimination, and not legal.

    And this is pretty much it in a nutshell. Had they allowed him to take the picture without making him change himself in any way, and he was detained because of it (say he decided to change his look to more masculine) or not allowed to do something because of it, that would have been on him (and possibly whoever detained him/stopped him from doing something).

    Now, though, the responsibility falls on the DMV and they are clearly violating the law here (it is sex/gender discrimination), so they are opened up to a lawsuit. Hopefully it will just be about getting a new license made as he wants to present himself, but he could go for more, and almost certainly would win.
