DMV is in the wrong. Nowhere in that law does it say a person must dress according to a narrow definition of what sheltered people think those with their genitals ought to look like.
It's obvious just by looking at him that this is his every-day wear. He's grown out and highlighted his hair. His eyebrows are shaped. His make-up looks just like the make-up we see on plenty of women -- it's not "costume make-up." That's all a result of months or years of practice, and these are things that take time to create.
I've never heard of the DMV saying this to a woman who wears make-up.
There is no reason to refer to someone as "it" unless you are being intentionally insulting. If you are truly totally stumped about someone's gender, "they" is an option which doesn't refer to someone as an object, and you know this.
The difference between his picture in the DL and everyday image are negligible. I'm not sure what the DMV people proved anything by having him take his make up off. All they did was give him fodder for cries of discrimination.
