Judge puts U.S. Rep. Conyers back on primary ballot[W:28]

Re: Judge puts U.S. Rep. Conyers back on primary ballot

Holy **** that is hilarious. It is not conservative because you disagree with it!

Nobody said it was. The other judges held the conservative view which is why their ruling differed from Roberts. Or are you suggesting that the other judges who voted to uphold it aren't really conservatives?

Re: Judge puts U.S. Rep. Conyers back on primary ballot

Has online voting ever been proposed?

I didn't mention online voting. I said registration of voters. To answer your question however, yes, it has been proposed, but not made into law... yet.

Re: Judge puts U.S. Rep. Conyers back on primary ballot

So, then stick with the Conyers case here....That is after all what the OP is about...He didn't have enough valid signatures to be on the ballot, and a Judge appointed by the Obama administration over ruled the Sec of State's office in Michigan to place him on it anyway...You don't see anything wrong with this?

John Conyers is a good example of what is wrong with the black community today but I think you're making more out of this then is really there. Someone who has been in Congress since the Charlemagne administration should definitely have the process down by now but his petitions were thrown out on technicalities that really go against the spirit of the petitioning process.

Re: Judge puts U.S. Rep. Conyers back on primary ballot

Not sure why this is a partisan issue. The people impacted are the democrat challengers to Conyers seat and the democrats of Michigan.

"Conyers turned in 2,000 signatures and more than 800 were disqualified for a variety or reasons, ranging from the signature wasn't from a registered voter or that voter didn't live in the district, the petition was misdated or contained an improper address.

Rev. Horace Sheffield, the Detroit Democrat who is running for Conyers' seat in Congress, challenged the petitions, arguing that many past candidates have been able to abide by the rules requiring petition cirulators be registered voters and that Conyers should too.

Another 644 signatures were thrown out by Wayne County Clerk Cathy Garrett because they were obtained by circulators who were either not registered voters or weren't properly registered to vote. As a result, Garrett ruled that Conyers had turned in only 592 valid signatures and she threw him off the ballot."

Re: Judge puts U.S. Rep. Conyers back on primary ballot

If you are looking for examples, you could start with the judge decisions to overturn state law and constitutional amendments on gay marriage.

Which has a precedent in a California Supreme Court case from 1948, Perez v. Sharp.

The funny thing is that it was a oppinion from Antonin scalia's dissent in Lawrence v. Texas that has provided the judges the ability to rule in favor of gay marriage.

Re: Judge puts U.S. Rep. Conyers back on primary ballot

The Conservative belief must not have been applicable.

Which is why I used it as an example of Roberts not being a consistent conservative. He is, as I said, a consistent consensus builder. He isn't a consistent conservative.

Is being a consistent conservative a requirement for judges?

Either way. He asked for examples. Or..you could look at just about the 9th Circuit Court of Appeals puts out.

Re: Judge puts U.S. Rep. Conyers back on primary ballot

Then what was the comment you made about a judge joining the liberals as opposed to the conservative ones?

Because Roberts didn't side with the conservative judges who held the conservative view. Same as what happened on the ruling on the mandate, where the conservatives ruled as conservatives and Roberts didn't.

All that was just a technicality, or 6.

Conyers turned in petition signatures of which about a quarter met state requirements. Conyers is a seasoned politician who at the least should know his own states election laws. He apparently didn't. Judge thought he should not have to abide by the rules.

Judge was wrong.

This -------------------------------------^

You'd think Conyers would know the rules after all his years of being a politician representing his district.

If I were Horace Sheffield, I'd be pretty pissed at the judge.

So all conservatives think just alike on all issues? Really?

You said he was a consistent conservative. He isn't. You asked me to show you a single ruling to back it up. I showed you a very big and very controversial ruling.

He isn't a consistent conservative. He's a consistent consensus builder. There are consistent conservative judges on SCOTUS - he isn't one of them.

The reason the judge ruled this way was that there was a decent chance(paraphrasing) that when the court case goes through, the requirement for circulators to be registered voters will be deemed unconstitional under free speech. If that is the case, keeping Conyers off the ballot would be unfair as he would have been unable to run even though the law was unconstitutional. As such, the judge ruled he be added to the ballot. Many stays(which this essentially is) are done for similar reasons: there is a decent chance(note this does not necessarily mean a good chance) he will win in court, and not issuing the stay would clearly harm him. Interestingly, this is almost identical language used as with the stays in several states on rulings against state bans on SSM.

Now there are several issues in this case I am unclear on, but I do understand the ruling. Not sure I like it (when I get home and can actually look stuff up on computer instead of pain in ass tablet will maybe get a better feel for my opinion on it.

Your whole reason as to why his ruling was not conservative was based on what you and other judges thought was the right ruling. So to you what conservatism is is based on popularity? Can you at least explain how his ruling violated what you consider conservatism to be?

Re: Judge puts U.S. Rep. Conyers back on primary ballot

Created the situation where GOP governors can deny citizens Medicaid, as with 76,000 in Georgia just for starters.
The Robert's court rulings on Citizens Divided 1.0 and 2.0 make Rehnquist look like a liberal.
And then we have the VRA ruling which has allowed Southern and GOP states to play voter suppression far beyond voter ID.
This certainly makes Roberts a far-right conservative, though he does worry about his legacy--he should .

Re: Judge puts U.S. Rep. Conyers back on primary ballot

Is being a consistent conservative a requirement for judges?
It was in the Senate when the GOP continued to filibuster Obama appointments to the bench.
Hence, the "nuclear option".

If the GOP takes the Senate,
zero appoointees to the bench or anything else will be approved until there is a GOP President or the GOP loses the Senate .

Even if you add in the 2 circulators, there were still 800 signatures that were disqualified. Right or wrong (and again...unless you are from Michigan and really, a democrat this shouldnt matter) I cant say I would be shocked if there wasnt a little bit of political rhythm from a fed appointed judge for and on behalf of a long standing seated rep. I aint sayin...Im just sayin...

Is no one else repulsed at the notion of an ideologically leaning justice (conservative AND democrat)?

Your request to me:

Name one case that he ruled in a manor at odds with conservatism.

I assume you meant a "manner" so I gave you an example.

Research the case they ruled on and read the rulings including the dissenting opinion. I agree with the dissent.
