This is not unexpected, Oregon is a very liberal state....It will be appealed.

I already reminded him of that....just like WA which he also thinks is blue.

It is, but barely.
 
The two words in title that don't jive "ruling" and "win".

What do you think will affect the OR court's final decision...what law will they base their decision on?

Just reminding him that his vote will always be meaningless living where he does should be enough. It gets canceled out in Snohomish County.

Isn't oregon the one, or at least first, state with legal assisted suicide? But yeah i'm sure like most all states its cities and college areas are more liberal while the small towns are stuck in 1950s

Most of us dont care which branch of government steps in to protect our rights, as long as they ware protected.

Which is still a win. Votes take time. In many states that have had their bans/laws overturned as unconstitutional by judges, we know that the public support actually is there, especially the ones where it is already legal, they are not waiting on any appeals. The only problem is that many states only allow votes during certain times of the year or even during certain years. Some only allow them every 4 years. Some others only allow a vote on a constitutional amendment, for the state, after 2 votes 4 years apart to overturn a previously enacted amendment (I think Nevada and/or Colorado has this issue because their legislature is trying to push this through but in order to get it via legislation/voters, it will take at least 4-8 years for it to go through due to these restrictions. Whereas a judge simply ruling the laws/bans unconstitutional (which they are) takes much shorter time.

The thing people tend to not understand on this issue is that voters change opinion faster than legislation can catch up, much faster than legislation can catch up. And you really only have so many die-hards on either side where this is an important issue for them. Many people couldn't care less if people of the same sex are allowed to marry because they feel it doesn't affect them whether they are or aren't.

Well, I believe the Judges do their job well. They don't make laws (all whine aside) they insure what is made into a law passes Constitutional muster. Judges are not perfect but they are irreplaceable. Our nation was founded on a Constitution tempering majority rules.

I would think libertarians would be for expanding the rights of all and not allowing some folks to try and restrict the rights of a few from enjoying full equality.

I don't want to marry a Dude, I picked a female to go through life with. That said I don't see who has the 'right' to tell consenting adults they can fight for the country but not all the blessings some go on and on about...
