    He should issue orders to make them stop

    That doesn't change the fact that the president can put it to a stop with an executive order.

    No where does it say that the NSA is mandated by law to conduct these surveillance operations.

    Oh sure, he could....but the House members or the Senators up for re-election don't want to miss their chance to vote on it. They need their chance to grandstand too.
