Maybe so, but I doubt that the court will see it as sufficient justification for shooting and killing another human being.

Agreed. Not murder 1, but murder 2. He shouldn't have shot the guy, should have just pistol whipped him instead.

Well, his age and the circumstances would have probably kept him out of prison, this being his first offense (on assault). He's going to prison now.

Fine...but Australia also has similar suicide stats from a much more 'western' perspective.

And it WOULD be swell if everyone was as reasonable as you. If that were the case people wouldnt be so stupid as to say gosh...an Island like England with a much smaller and less diverse population seems to have fewer murders than in the US. The point IS well take. The US is not like ANY OTHER country.

How about we just keep talking about homicides and gun violence and the perpetrators of the vast majority of all of those crimes, the lack of concern expressed by those that bleat on about their cause and target law abiding citizens, and if you dont like it dont bother responding.

Ozclapistan is what the US would have been had the US population not wanted more. And the UK, much like the rest of Europe, has a long feudal and monarchy history which tends to embed the you exist to the benefit of the state mentality.

I have not seen anything indicating that he was legally carrying.

My brother in Tampa knows the theater and advised it was no carry.

My brother in Tampa knows the theater and advised it was no carry.
Can you post a reputable source for that information? Not calling your brother a liar but that's not what I would call a valid source.

The Cobb movie theater where Monday's shooting occurred does not allow handguns or other weapons under a company policy in place since October 2012.

Red and black stickers affixed to doors alert moviegoers to the ban, and the company maintains that violations "may result in expulsion," Cobb spokeswoman Molly McFerran said.

But while Florida law bans guns in some places even for concealed-permit holders, movie theaters aren't among them, raising a few legal questions. Is it legal to carry a gun onto private property where the owner has banned them? Does the property owner have the right to refuse service based on someone carrying a gun?

The questions are more than academic because the suspect in Monday's shooting could carry a concealed weapon because he was a retired police officer.

Under Florida law, guns are banned at airport passenger areas, police stations, governmental meetings, elementary and secondary schools, polling places, courtrooms and a handful of other public places.

They are not specifically banned by law from theaters, however, so a person with the right to carry a concealed weapon would not be breaking any law by ignoring the property owners' warning, said Bruce Bartlett, recently retired chief deputy state attorney for Pinellas and Pasco counties.

However, "he would still be subject to being thrown out,'' Bartlett said.

Criminal defense attorney Mike Kenny, who has offices in Tampa and Port Richey, agreed: A business owner has the right to refuse service or eject someone who brings in a gun.

Works for me as a source - and it shows it was still legal for him to be carrying.


As an aside, they should also charge him with trespassing. He obviously wasn't welcome there, and he knew it.

clearly this man has a screw loose and should be behind bars. However I can't wait to hear his side of the story(and maybe some witnesses). There has to be more to it than what has come out. There must have been some kind of exchange between the two men before all this went down. Could the victim have escalated the situation not knowing his life was in danger? It will be interesting to hear.
