    Theater's gun ban raises questions about law

    The Cobb movie theater where Monday's shooting occurred does not allow handguns or other weapons under a company policy in place since October 2012.

    Red and black stickers affixed to doors alert moviegoers to the ban, and the company maintains that violations "may result in expulsion," Cobb spokeswoman Molly McFerran said.

    But while Florida law bans guns in some places even for concealed-permit holders, movie theaters aren't among them, raising a few legal questions. Is it legal to carry a gun onto private property where the owner has banned them? Does the property owner have the right to refuse service based on someone carrying a gun?

    The questions are more than academic because the suspect in Monday's shooting could carry a concealed weapon because he was a retired police officer.

    Under Florida law, guns are banned at airport passenger areas, police stations, governmental meetings, elementary and secondary schools, polling places, courtrooms and a handful of other public places.

    They are not specifically banned by law from theaters, however, so a person with the right to carry a concealed weapon would not be breaking any law by ignoring the property owners' warning, said Bruce Bartlett, recently retired chief deputy state attorney for Pinellas and Pasco counties.

    However, "he would still be subject to being thrown out,'' Bartlett said.

    Criminal defense attorney Mike Kenny, who has offices in Tampa and Port Richey, agreed: A business owner has the right to refuse service or eject someone who brings in a gun.

    clearly this man has a screw loose and should be behind bars. However I can't wait to hear his side of the story(and maybe some witnesses). There has to be more to it than what has come out. There must have been some kind of exchange between the two men before all this went down. Could the victim have escalated the situation not knowing his life was in danger? It will be interesting to hear.

    I'm sure he'll spend the rest of his natural life in prison, which he should! He gives all gun owners a bad name!!

    I knew there was more to the story. While I agree the shooter is crazy, eyewitnesses say the shooter asked the guy to stop texting, went to get a manager to complain, then when the shooter returned they argued more and the victim threw his popcorn on the shooter. Again, this doesn't mean the guy deserved what he got or the shooter isn't a wackjob, but what I will say is you never know what a stranger is capable of. and instigating a physical confrontation is always a risk to your own life.

    No, the ex-cop contributed to escalating the situation. Looking at text messages before a movie starts is what 90% of what moviegoers do before a movie starts. I'm basing this off of casual observation of course. Furthermore, if you've read through the entire thread you'll also notice that at least one other couple has come forward and explained that this ex-cop's behavior is typical. Lastly this ex-cop went to see management about the situation and nothing was done. Why? Because texting before a movie is no big deal. This ex-cop is a murderer.
