Police not guilty in Kelly Thomas death; DA won't try 3rd officer[W:173:381]

Police not guilty in Kelly Thomas death; DA won't try 3rd officer

Mornin' SMTA. :2wave: Yeah I think the part about taking him down with the Zip Cuff when the third officer arrives on the scene puts that into perspective.

Morning my friend!

I don't doubt that force was required to restrain him.

The issue was that the force became excessive, resulting in death.

The cops were guilty of the same groupthink brutality as with Rodney King.

Their vindication will result in increased loss of citizen rights and safety.

While I support the jury system, mistakes are made.

This is one of those mistakes.

The CA citizens deserve the brutal police behavior that the jury condoned.

I have been a cop and understand the mentality quite well.

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

This was expected, as the Officers were dealing with a person resisting. They had to use force to get him to comply.

Have you seen the video? The cop instigates the entire episode with an unprovoked baton blow to the guys midsection. This is yet another travesty of justice. What is wrong with our justice system in America?

Ah hello?
Have you not been paying attention?

The coroner's office determined that Thomas died of brain damage from lack of oxygen caused by chest compression and other injuries sustained during his struggle with police.

That is a direct result of his resisting.
If he hadn't resisted he would still be alive.

You force police to get on top of you to subdue you, and you are responsible.

Wrong. These rogue officers give good cops a bad name. This is a clear case of police misconduct...its just too bad that too many citizens are willing to give bad police a pass on things like this.

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

They beat a man to death.

Don't start a fight you can't or aren't prepared to win (at any cost). - Words to live by.

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

Don't waste time on him.

He is baiting and trolling.

Ignore feature is your friend.
Said the one engaged in such behavior.

Wrong. The blow was not unprovoked.
Kelly had laid hand son an Officer and then failed to comply when told to get on the ground. And instead of complying he then attempted to flee.

Wrong you are. They are not rouge Officer.

Have you watched the video? The blow was absolutely unprovoked....and BTW...I think any reasonable person would try to get away from a cop that just landed a blow to your midsection with his baton. The guy knew that these cops were going to beat the **** out of him.

Like Rodney King? How about the dead guy in the BART station? Sorry...but the law is clear, there is no law against resisting an unlawful use of force. In fact, the jury instructions are very clear that if the cops are using illegal or excessive force, there is no requirement that the citizen submit to their unlawful use of authority. Try again.

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

I've been working with the Innocence Project and I can tell you that cases like this go under-reported and even if a man survives hes scarred for life and the judicial system does everything possible to find the man guilty so he cannot sue the state for damages, while the state system treats the officers as just "doing their job" - "a high stress job" - meanwhile people are being murdered or permanently disabled or disfigured.

I think there should be more psychological training (including the "cop gang mentality") and more social understanding of the potential communities they could be working in (among numerous other criteria that could put an end to all this barbarian police brutality)...

Everyone isn't a "bad guy" and should not be treated as such - many times they're the victims....

I'll say this once - if you're the alleged "victim" (as claimed over a 911 call) the real victim could have done nothing wrong and have his ass kicked just because of a "he-said-she-said" er hearsay.

How is one going to kill or beat someone up on hearsay when such a direct is not even applicable in court under the majority of circumstances?

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

Beating someone into a coma, that lead to his death, is not adequate force to make someone comply. They went over the limit and should be in prison.

No

Thomas's actions caused his death.

What, I still can't figure out... is how someone can watch, the video and come to the conclusion that this dude was being cooperative and not resisting.

No

Thomas's actions caused his death.

No, they didn't. The police overreacting to his actions caused his death. The death is on the cops hands and they should be in prison.

What experience do you have in trying to restrain someone that is actively resisting plus when *said* individual is altered due to alcohol, drugs or mental issues?

None. But that doesn't matter. The police aren't supposed to kill someone unless their life is threatened in an immediate way, which wasn't. The police aren't supposed to kill someone in the act of subduing them. It is ridiculous that people are defending these murderous assholes.

He wasn't resisting until the cop took his baton and wielded an unprovoked blow to the mans midsection. After that...of course he would try to get away. Anyone would want to get away from a group of people hell bent on beating them to death.

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

That thin blue line....

some are more equal than others apparently.

Re: Police not guilty in Kelly Thomas death; DA won't try 3rd officer

Wrong.
Compression of his chest is what happened.
That compression caused by Officers trying to subdue him, as he was resisting.
His resistance makes him the blame.

Cops beat a man to the point that he dies, and it’s the man’s fault for resisting.
I’m sorry but I’m awestruck that there are people this stupid in the world.

Plus, the idea that he was "resisting" is very much up for debate. I refuse to link the video of the beating here, since it's absolutely heinous, but it's out there.

I wouldn't say he was being "cooperative;" however, his level of "resistance" did not merit the force used to subdue (and eventually kill) him. If cops are going to use force, it is their responsibility to use an appropriate level of force. They clearly did not in this case.

You force police to get on top of you to subdue you, and you are responsible.

Even if they instigate/escalate/etc it?

So basically, we are supposed to take it?

"Sir, how can I help you"
::baton to stomach::
"STOP RESISTING"
"I didn't do anything"
"HE'S RESISTING!!!"
::kick to face::

you see where I'm going with this?

The accountability isn't there anymore.

Jose Guerena shooting - Wikipedia, the free encyclopedia

Read about this....I can't wait till his family/fellow soldiers get their hands on the scumbags that murdered this Marine. No-knock, combat vet without a single instance of criminal activity, gunned down by some trigger happy thugs in his home for trying to protect his family from what he thought was a home invasion. Karma comes around. I hope his family beats Karma to it.

"Resisting" is strictly interpretation these days. They make the rules up as they go.

Precisely. And once the use of force has been self-justified, there seems to be no concept of degree. It's either no force, or beat the guy within an inch of his life (or worse).
