    Man arrested with cache of guns, explosives

    Interesting reason the first officer started asking questions of the man
    Man arrested with cache of guns, explosives

    An Indiana man is in the Tri-County Regional Jail on a $1 million bond following his arrest with four guns and nearly 50 bombs.

    Andrew Scott Boguslawski, 43, of Morris Hill, Ind., is being held, charged with one count of illegal manufacture or processing explosives, a felony of the second degree. He is set for a preliminary hearing Friday, Jan 10.
    <snip>
    The prosecutor said the trooper was prompted to ask about weapons because of several bumper stickers on Boguslawski’s car —specifically a sticker warning “If you can read this, you’re in range.”

    Boguslawski told the trooper there were no guns in the vehicle. Davis went to write the man a ticket and when he returned to the car, he noticed the handle of a gun between the man’s knees.

    Lt. Col. Cathy Van Bree, a spokeswoman for the Indiana National Guard, said Boguslawski is a specialist in the guard who does intelligence analysis and has top-secret clearance.

    maybe though a good defense attorney is going to claim that the bumper stickers don't give rise to probable cause

    one state-I cannot recall which-justified dog sniffs on cars pulled over with Grateful Dead stickers. I believe a lawsuit put an end to that.

    This will be an interesting First and Fourth Amendment issue in a motion to suppress if one is filed

    He had a gun between his knees!!! I don't think this is a freedom of speech issue here.

    I didnt get that he was pulled over due to the weapons suspicion...but that he asked about weapons due to the bumper sticker. The probable cause thing comes from seeing the butt of the weapon between his legs, right? (NOT a lawyer BTW...)

    4 guns is not a cache of weapons, its not even an arsenal, its a salacious headline that matters not. The explosives are the only issue here, for without proper permits explosives are only available to those in the industries that use them.

    He was pulled over for speeding-that was PC to stop the car. To ask about the weapons due to the bumper sticker?

    I think the cop is going to be sustained on this one but I was noting what the defense should be

    If you are moronic enought to hide a gun between your knees during a routine police check, you deserve to be in prison for stupidity.

    Indiana permits to carry are very easy to get-so easy they are not recognized in Ohio (though ours are in Indy!)

    The cop asked a question, "Do you have any guns in the car?" Boguslawski answered in the negative and it was only when the officer actually saw a firearm in the vehicle that the man was arrested.
