The key here is that none of the black assailants broadcast up front that they were going to smack a white guy. Therefore, you cannot say whether or not it is a hate crime. You can't prosecute someone because you believe you might know what he is thinking. Charging the white guy with a hate crime is not racism against poor defenseless white people, as some of the Stormfront crowd is claiming. The white guy said up front that he was going after a black guy. THAT is what made it a hate crime. To spin this into a story that somehow the system is racist against white people is absolutely insane. If this is to be a story about white people, then let's call it what it is. This white man is a freakin' idiot, as well as a thug. End of story.

Postscript. In Texas, there is an enhancement if your assault was against someone 60 years or older. He's gonna get that too, and he is going to spend years behind bars, where he belongs. So, to the Stormfront crowd, keep crying your crocodile tears of fake rage. The racism here is not what is being displayed by the government. It's the racism being displayed by YOU, and it sticks out like a sore thumb.

I gave your post a :thumbs: because you saw the act for what it is - assault, plain and simple.

That said, I do get what MrVicchio is saying here, "Why does Justice Holder choose to call this a hate crime when it's been going on for so long with other racial demographics, i.e., black-on-black, black-on-white, but suddenly when it's a young white boy attacking an elderly black man is a hate crime?"

I'd like to think it's just a matter of bad timing, like a District Attorney who is up for re-election suddenly deciding it's time to make an example out of certain law breaker to show the next perpetrator of the act he/she means business. That seems to be the case here as stated by Justice Department officials in the OP article:

It could also be one of those rare times when the video evidence clearly shows that the assault was racially motivated. These two YouTube videos from local/regional news detailing the storyline makes it clear that the assailant purposely selected a black man, had the assault recorded via his cellphone, then went on to brag about it.

Now, video taping the knockout event probably takes place more often than people think; it's like a trophy for this kids to prove they actually did it. Regardless, I see this as the straw that broke the camel's back rather than a purposefully selected white guy the Justice Department choose to go after in a post-Travon Martin world. Clearly, prosecuting the three young men out of Oklahoma wasn't enough, nor the teen in NYC for allegedly punching a Jew. Mind you, hate crime charges were filed in the two aforementioned cases at the state level, yet the crime still goes on. Maybe it's time a few of these thug teens see time in a federal prison, then maybe other teens will begin to think twice about doing this.

Well, the problem I have with what you are saying is this. Almost anytime it is white-on-black violence, people argue that racism needs to be proven (as in this case it is), while in black-on-white crimes, racism is taken for a given, even though there is no evidence that a white person was attacked primarily for being white.

Huh. I don't see it that way at all. In fact, the way I see it is that in pretty much any case of white on black violence a racial element is simply presumed.

The government is stipulating the game is as old as 1992, and has had other names.

"According to the Justice Department complaint, there have been "knockout game" incidents, some of which have been called other names, as long ago as 1992."

Hate crime laws in the United States protect against hate crimes (also known as bias crimes) motivated by enmity or animus against a protected class. Although state laws vary, current statutes permit federal prosecution of hate crimes committed on the basis of a person's protected characteristics of race, religion, ethnicity, nationality, gender, sexual orientation, gender identity, and disability. The U.S. Department of Justice (DOJ)/FBI, as well as campus security authorities, are required to collect and publish hate crime statistics.

Note the term "crimes motivated by enmity or animus against a protected class." Holder is just doing his job as defined by the law.

Hate crimes can and have been prosecuted with white victims not within another protected class, silly goose.
