    I have heard one of the legal commentators on HLN indicate that probation for these circumstances (Drunk driver involved in an acceident resulting in death) is fairly common. While the argument the defense attorney used is ridiculous, the outcome might not be as ridiculous as originally thoguht- assuming that commentator was correct.

    The kid shoukd have done jail time over this no doubt.

    But I've always thought the penalties for DUI in general were way too harsh.

    Getting caught with a limit just above the .08 standard can cause life altering penalties that do not equate to the crime.

    And they've gotten to this level because of the actions of lobbies who represent the worst case scenario of DUI cases.

    Our laws used to be shaped around reasonable responses to illegal acts.

    Groups like MADD shouldn't have the power to enable more Governmental power over the private individual.

    Minor cases of DUI have turned into a revenue source for municipalities as they use demagogy , with the help of groups like MADD, to justify the consequences.

    This sort of thing is why I believe that ANY individual of ANY age who willingly and knowingly gets behind the wheel of a motor vehicle after having drunk alcohol within the last 12 hours should be charged with FIRST DEGREE MURDER, should they kill anyone while behind the wheel of that car. There is NO ACCEPTABLE REASON for anyone who has had a drink to be behind the wheel of a car, period. Doing so, at least in my mind, constitutes an active and knowing disregard for the safety of others and of themselves by placing them in charge of a weapon of the dealiest caliber.

    Exactly which is why I don't think the 10 year probation sentence is wrong for the teen. You don't want to turn him into a violent criminal, but one of the parents should serve some jail time on his behalf for creating the kid and his belief that he is above the law. They can pick which one.

    They should cut his balls off, so he cannot pass on his stupid.
    Climate, changes. It takes a particularly uneducated population to buy into the idea that it's their fault climate is changing and further political solutions can fix it.

    WHAT?????? Holy hell....I'll fully agree that the kid needs treatment, but damn.....

    I thought Texas was a "hang 'em high" kinda place?

    Jail sure isn't going to change anything for anyone in this scenario, but christ on a cracker......

    He even STOLE the beer......

    And some people wonder why there's anger and frustration towards the rich and privileged.
    Appalling, yes. But, since he was a minor, did that play a role in the judge choosing leniency?

    Maybe we ought to outlaw children from driving...but, judging by the number of laws this kid broke, I doubt one more would have mattered.
    * stole the beer
    * minor drinking
    * driving with too many minors in the car
    * driving without a licensed adult or guardian
    * drunk driving

    Christ!

    Actually sounds like something a Canadian judge would do.

    I'm guessing the families of the decedents will be visiting a civil court one day very soon.
