Not familiar with the whole story by prohibiting pictures and video inside your business is well within your legal means and doesn't violate anybody rights.
Now i dont know if this guy was just kicked out, or asked to take the glasses off and he refused or he was banned etc and theres probably a good tact a buisness could practice but besides that i dont see anything wrong here.

A guy pointing what is effectively a video camera at everyone continuously? Throw the bum out. If someone was continuously recording people with a cell or smart phone? Throw that bum out too.
Personally, I'd prefer a restaurant that prohibited people using cell phones inside. What to chatter with people not there? Go outside. Many basically shout into their phones - I suppose to make SURE everyone else hears.
I also think a business assuring privacy would be desirable to some people.
