    Homeowner in Renisha McBride's killing to face murder charges[W:287]

    A homeowner will be charged with second-degree murder in the shooting of an unarmed woman on a suburban Detroit porch earlier this month.

    Renisha McBride, 19, was killed on Nov. 2 in Dearborn Heights, Mich., when she went to a man's porch seeking help after a car crash, according to police.
    Manslaughter, yes, but murder? I just don't see it. Murder has to involve malice, and I don't see malice here. I do see manslaugher, but murder charges are ridiculous. What does everybody else think?

    I agree with you. There is not nearly enough evidence for a second degree murder charge.
    I call my own shots, largely based on an accumulation of data, and everyone knows it.

    I agree that intentional murder is a high bar to prove. I wonder why she went six blocks away from the crime scene (drug/alcohol impaired driving causing property damage) of her "accident" for help and just what constitutes evidence of knocking on a locked door yet no evidence of attempted entry.

    Yeah, manslaughter would've been an appropriate charge. Even that could be tough, a good defesnse lawyer could easily use her toxicology report to shoot some holes in that. Has the makings of another emotionally charged trial.

    Well the guy deserves to stand trial.

    I for one hope that this won't turn into another TM... with all the race-baiting loonies coming out of the woodwork.

    Second Degree Murder: Definition

    Second-degree murder is ordinarily defined as: 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"; or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. Second-degree murder may best be viewed as the middle ground between first-degree murder and voluntary manslaughter.

    Apparently, the DA is not prepared to buy his "oops." According to a story I read (not sure about above), she knocked on a locked screen door. There was no evidence of attempted forced entry.

    Michigan has a stand-your-ground law. Now. Will people PLEASE stop griping that it's a license to kill????

    Driving drunk and/or stoned and crashing into a parked car makes you a victim? Why not seek help at/near the "accident" scene? Why wait two hours and go six blocks? Seeking help could amount to honking the horn or screaming for help.
