A homeowner will be charged with second-degree murder in the shooting of an unarmed woman on a suburban Detroit porch earlier this month.

Renisha McBride, 19, was killed on Nov. 2 in Dearborn Heights, Mich., when she went to a man's porch seeking help after a car crash, according to police.

Manslaughter, yes, but murder? I just don't see it. Murder has to involve malice, and I don't see malice here. I do see manslaugher, but murder charges are ridiculous. What does everybody else think?

I agree with you. There is not nearly enough evidence for a second degree murder charge.

I agree that intentional murder is a high bar to prove. I wonder why she went six blocks away from the crime scene (drug/alcohol impaired driving causing property damage) of her "accident" for help and just what constitutes evidence of knocking on a locked door yet no evidence of attempted entry.

Yeah, manslaughter would've been an appropriate charge. Even that could be tough, a good defesnse lawyer could easily use her toxicology report to shoot some holes in that. Has the makings of another emotionally charged trial.

Second Degree Murder: Definition

Second-degree murder is ordinarily defined as: 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"; or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life. Apparently, the DA is not prepared to buy his "oops." According to a story I read (not sure about above), she knocked on a locked screen door. There was no evidence of attempted forced entry.

Michigan has a stand-your-ground law. Now. Will people PLEASE stop griping that it's a license to kill????

People are already blaming the victim for staggering too far while seeking help.

Driving drunk and/or stoned and crashing into a parked car makes you a victim? Why not seek help at/near the "accident" scene? Why wait two hours and go six blocks? Seeking help could amount to honking the horn or screaming for help.

I agree. That young lady should still be alive, but charging the guy with murder is over the line.

How does shooting somebody in the back of the head not involve malice?

edit: Hrm, this article says she was shot in the face. A different one I read said back of the head. Hooray for journalism.

You answered your own question. She was drunk/stoned and not thinking clearly.

Personally, I think it's good he was brought up on charges. There are definitely enough questions involved in what happened to warrant them. Regardless of her state of intoxication, it's pretty hard to argue that she was any sort of threat on the other side of a locked door. Murder charges do seem to be going a bit far, but it's probably a tactic to try to force a plea deal and avoid a high-profile, racially charged, expensive trial.

No but paying home visits to complete strangers in the middle of the the night while drunk, high and bleeding is not the best of ideas.

I wouldn't think so. But where I come from, being shot dead while seeking help certainly does.

Seeking help is a theory not a fact. No help seemed to be required for 2 hours and six blocks of travel.

You guys don't get it both ways. If you want yours guns you also get the responsibility. If you kill someone for no good reason you go to prison for the rest of your life, just like everyone else.
