Gay rights bill passes first major hurdle in Congress

The Senate voted to proceed with a landmark anti-bias gay rights bill Monday, reflecting the dramatic shift in national attitudes towards the acceptance of homosexuality that has taken place since similar anti-discrimination legislation was rejected by lawmakers two decades ago.By a vote of 61-30, the Senate effectively ended a filibuster, allowing it to debate the Employee Non-Discrimination Act of 2013.
The legislation would prohibit workplace discrimination against gay, bisexual and transgender Americans. The bill is expected to pass a final senate vote, but is slated to face strong opposition in the Republican-dominated House of Representatives.

Good news! But now all it has to do is pass the Republican controlled house, too bad that Bohner for some reason wants to hold back equality...
 
That anyone could oppose such a move would boggle my mind. No one should be fired from a job unless they're unable to do it. Discrimination over who a person is rather than what they do is just stupid.

This is a great move. I hope the house Republicans don't screw it up.

But, that's the bad part of it. What if a person is fired for being incapable of doing the job and they bring suit against the employer saying that they were fired for being gay? Win or lose, the employer still has to pay legal bills and faces irreparable damage to their reputation.

Quite frankly, I see this as another democrat give-away to the trial lawyers.

Well saying that doesnt happen much of all with the already civil rights law based off of race, disability, and sex....

Then they are going to be held to the same standard as someone who claim race and religion are the reason for being fired. Contrary to popular belief, you don't get to claim racism or religion as the reason for being fired and then get a nice reward for it. There are standards that have to be met in order for such cases to even be considered by judges.

No. Proving that racial discrimination has occurred is not easy. This is because:

the person claiming discrimination has to prove it 'on the balance of probabilities', although there are differences depending on what racial grounds are cited:
grounds of race of ethnic or national origins: if the person must establish the facts from which an employment tribunal can conclude that an act of racial discrimination or harassment on grounds of race or ethnic or national origins has occurred, the employer will have to prove that any difference in treatment was not due in any way to discrimination or harassment. If the explanation is inadequate or unsatisfactory, the tribunal must first find that unlawful discrimination has occurred;
grounds of colour or nationality: where the discrimination is on grounds of colour or nationality, if the person establishes facts from which an employment tribunal could conclude that he or she has suffered racial discrimination, the tribunal will ask the employer for an explanation. If the explanation is unsatisfactory, the tribunal may find that unlawful discrimination has occurred.

the law on racial discrimination is complex and you will probably need some specialist advice and assistance in preparing and presenting your case
in some non-employment cases it can take up to two years before the case is heard

If you have a low income, you may be able to obtain advice at the early stages of your case (but not representation at the tribunal hearing) from a solicitor. Public funding is available for all the appeal stages of a case.

But, the situation still remains. The employer still has to pay for a lawyer and their reputation is still damaged.
What's he going to do? Sue the plaintiff? They're unemployed. And not likely to be employed since they got fired for being incompetent.

Doing all the reading I do its interesting seeing all the new support including GOP support, i dont think its going to pass YET unless its a move by the GOP to gain some support from gays and the many Americans that support equal rights gaining into elections. And that isnt my thinking that comes from the reading and ideas being thrown around by "some" GOP members.

Theres an interior GOP push for this due to some larger monetary supporter favoring the bill, members that are gay or have gay family members and people who think this could spark a better view of the GOP on social and equal rights issues.

not to mention idiot people claiming false suits is NO reason to protect peoples rights.


Bad cops plant evidence
Bad judges make faulty rulings
Women falsely claim rape

etc etc etc

that doesn't mean we get rid of all cops, judges and drop rape as a crime.

There will probably be more lawsuits over this than people going bankrupt over medical bills.
Yet, for that they disrupted our entire medical system and called it "obamacare".

Perhaps you should be fired for being heterosexual to see what it's like. Oh wait, this would never happen. Rampant selfishness and doomsday predictions do not impress.

Anybody can come up with a phony lawsuit. Democrat lawyers are not short of cases.

As far as I can see, this is the only major accomplishment Obama has delivered during his Presidency. Not much else has looked like progress. But it's about time we sorted out this equality thing. These aren't aliens or immigrants. These are your fellow natural born americans and they should not be lesser simply because of a gender attraction choice.
 
Yeap. Everyone has a natural human right to work for whatever private company they want.
