    Racism depends on the motivation. It appears this may not have been a deliberate racist comment, but it was certainly quite stupid. Hard to believe he did not know what the inference of 'Uncle Tom' is.

    Race matters but it seems to me that Blacks are being cast as marginal members of society if there are laws designed exclusively for them, and that would include affirmative action laws as well. Anyone who believes Black people need special laws or attention designed exclusively fr them has to believe in racial inferiority as well. You cant have one without the other.

    I think Black people would feel far better about themselves and their culture if they knew that the playing field was level, just as it is for others and just as many successful Black people have demonstrated.

    Is anyone going to claim that the intent of calling Thomas an Uncle Tom was anything other than: "Thomas is a shameless sell-out who identifies so much with the rich and powerful, mostly white, elites that he is willing to make decisions that harm his own oppressed people."

    If so, what do you think he actually meant?

    Would people in wheel chairs feel better about themselves if they had to use the stairs like everyone else? and, yes, blacks would feel better if the playing field was level ... the point is that it isn't, so we have to try to level it in numerous ways, just as we did for white women with affirmative action (they were the primary beneficiaries of it) ... this doesn't mrean one believes in blacks' inferiority ... rather it means that one believes racial discrimination exists ...

    What exactly is blacks' culture?

    Racial discrimination certainly exists if the laws are different for one race than another. In fact that's the essence of racial discrimination. Justice Thomas was not alone in finding this wrong. There were four others who decided the same way.

    In fact some of the worst examples of racial discrimination, and hatred, have been against Justice Clarence Thomas but he has few, if any, liberal defenders.
