    The U.S. Department of Justice may try seeking out the source of a bombshell article that revealed National Security Agency surveillance of millions of Americans, according to NBC News Justice correspondent Pete Williams.

    On Thursday’s "Morning Joe," New York City Deputy Mayor Howard Wolfson asked if [The Guardian's Glenn] Greenwald would be investigated and suggested the White House would face many questions about the Guardian story.

    “They may not be prepared to answer that question,” Wolfson said. “But given what happened with Fox, given what happened with AP, that will be a very hot topic today.”

    Williams, a well-sourced reporter who just interviewed Attorney General Eric Holder last night about the leak investigations, jumped in with an answer.

    I was told last night: definitely there will be a leak investigation,” he said.

    On MSNBC's "Daily Rundown" later Thursday morning, Williams slightly walked back his earlier comments from certainty to near certainty. "It seems highly likely this will trigger a leak investigation," he told host Chuck Todd.

    While no investigation is yet underway, Williams said, "It just seems very likely, given the sensitivity of this document, that there will be one."

    Rand Paul introduces bill preventing phone record access | The Daily Caller

    Kentucky Republican Sen. Rand Paul will introduce legislation to prevent the government from searching the phone records of Americans without a warrant based on probable cause when the Senate returns to session Friday.

    “The revelation that the [National Security Agency] has secretly seized the call records of millions of Americans, without probable cause, represents an outrageous abuse of power and a violation of the Fourth Amendment to the Constitution,” Paul said, announcing his intent to introduce the “Fourth Amendment Restoration Act of 2013.”

    “I have long argued that Congress must do more to restrict the Executive’s expansive law enforcement powers to seize private records of law-abiding Americans that are held by a third-party,” he said.

    Paul’s bill would halt the National Security Agency’s surveillance of Americans’ phone records and prevent any other “agency of the United States Government to search the phone records of Americans without a warrant based on probable cause.”

    “The bill restores our Constitutional rights and declares that the Fourth Amendment shall not be construed to allow any agency of the United States government to search the phone records of Americans without a warrant based on probable cause,” Paul added.

    Last year a Paul amendment to the Foreign Intelligence Surveillance Act Amendments Act Reauthorization Act of 2012 — which would have extended Fourth Amendment protections to electronic communications by requiring specific warrants to obtain that information — failed to pass a floor vote.

    In May, Paul introduced the Fourth Amendment Preservation and Protection Act of 2013, which also would extend Fourth Amendment guarantees to electronic communications.

    White House spokesman Josh Earnest defended the administration’s ongoing tracking of domestic phone calls in a conversation with reporters Thursday.

    The surveillance is allowed by a “robust legal regime” that reviews the use of the government powers under the Patriot Act “to ensure that they comply with the Constitution,” Earnest claimed, according to a White House pool report.

    “Authorities that are referenced by this reported order are something that have been in place for a number of years now,” Earnest continued.

    He declined to answer several questions about the specifics of the surveillance.

    Earnest also deflected a question about whether President Barack Obama approved of the surveillance that is conducted in his administration.


    “This strict regime reflects the president’s desire to strike the right balance between protecting our national security and protecting constitutional rights and civil liberties,” he said, without describing the protections for Americans, or the system’s ability to track terrorists and their supporters.

    Powers given to an executive almost never are given back. This is what all the howling was about back when they pushed the giant patriot act bill through congress after introduced just the night before. No one read it and Senator Feingold was the only Senator to vote against it because people were ceding to Bush anything he wanted after the attack on our soil and Cheney was constantly screaming "Unitarian Executive! Unitarian Executive! Unitarian Executive!" because he wanted he and Bush to have as much dictatorial power as possible. Bob Barr saw this and left the GOP to run for prez in 2008 as a Libertarian and that's why he ran on that premise about how executive powers constantly grow.

    And the way our legislature is now they are all too willing to give the executive all that power because then they can sit back and assume no responsibility for what goes on.

    Here's a fine example of that. Here is John Boehner today commenting on this wire tapping...

    "I trust the president will explain to the American people why the administration considers this a critical tool in protecting our nation from threat of terrorist attack," Boehner said at a weekly press briefing.

    "Why isn't the burden also on you to explain why this act was passed?" a reporter pressed.

    "The tools were given to the administration, and it's the administration's responsibility to explain how these tools are used," Boehner added. "And I'm hopeful we'll see these answers soon."

    Our government is just terrible.

    Obama could have stopped this if he wanted to. Since this program has expanded exponentially under his watch, he cannot pass the buck.

    He is now in his second term, any mention of Bush will simply be acknowledged as " I got my hand caught in the cookie jar, and I have nothing else to fall back on.

    I'm likely missing your point, but it should be noted I don't agree with this any more now than I did with Bush.

    AUSTAN GOOLSBEE: I think the world vests too much power, certainly in the president, probably in Washington in general for its influence on the economy, because most all of the economy has nothing to do with the government.
