    Second court invalidates Obama appointments to labor board

    Amidst all the scandal juggling.......

    A national labor board which has long been accused of making union-friendly decisions was dealt another blow Thursday, after a second federal appeals court found President Obama exceeded his power when he bypassed the Senate to appoint its members.

    The ruling by the 3rd U.S. Circuit Court of Appeals in Philadelphia once again threatened to upend the National Labor Relations Board's decisions. And it has the potential to stall the board entirely, as well as challenge other federal agencies that have similar appointees.

    I love how the strict constitutional types are totally in favor of Congress blatantly exploiting a loophole with the goal of blocking an express power granted to the president.

    Republicans, on the other hand, will go to work but not actually do anything. What's that, 38 votes in the House for repeal of Obamacare now? Glad they're using that taxpayer-paid time so well!

    So a second federal appeals court has found that President Obama exceeded his power when he bypassed the Senate in making these appointments. Who advised the President that he could do this? Or did he not ask because he is a so-called "Constitutional scholar"?

    Damn you, Obama! Why can't you see that the Republicans only have Labor's best interests at heart? That's why they'll continue to filibuster until you nominate someone like Dick McUnionSlaughter.

    Stop being an ass, Obama; they're the ones who received the minority of votes last election, so they should be the ones getting their way.

    I think he deliberately wanted to pick this constitutional fight.
    Congress has a long history of intentionally blocking an express presidential power using this shady tactic, under both Democrat and Republican presidents.

    The president is granted the power to make limited appointments during a recess. It's right there in the constitution. This power exists to make sure that the government can continue to function if Congress isn't around to do their jobs. What congress has been doing is deliberately blocking this constitutional power by holding fake sessions in which nothing is done. They last maybe two minutes. "We're convening. I move we adjourn. All in favor? We're adjourned!"

    I don't care what anyone says, that's not "in session." It's a bunch of five year olds sticking their fingers in their sisters' faces and saying "I'm not touching you! I'm not touching you! Mom said not to touch you and I'm not!"

    If the labor board decisions are overturned, how many businesses are going to have to rehire lawyers and go through months, or even years, of this process again? How many tax dollars are going to be spent redoing everything?
