Amanda Knox murder acquittals overturned!

Looks like they there will be another trial in this never ending circus, I hope for the Kercher families sake they have new evidence otherwise they are just opening old wounds for no reason. Highly unlikely that Knox will be made to return to Italy considering the the Italian justice system doesn’t have the same double jeopardy protections as America and is not going to extradite one of their own to face it in another country. Raffaele Sollecito on the other hand will probably end up standing trial again.

After the justice system over there was dragged through the mud, you'd think that country would not want to reinvigorate the scathing attacks on "kangaroo courts" that occurred last time round. They have a prisoner in jail whose guilt was far more obvious. No way she goes back. she just got 4 million for a book deal as well.

ive always been on the fence about how guilty she was, I think she had a part to play but I'm not sure she is a murderer. That being said the whole process has been a disgrace from the Italian Polices hack job to the courts, if I'm Knox I stay well away.
 
If convicted, she won't be extridated to Italy.

Per our extridation treaty with Italy:
ARTICLE VI

Non Bis in Idem

Extradition shall not be granted when the person sought has been convicted, acquitted or pardoned, or has served the sentence imposed, by the Requested Party for the same acts for which extradition is requested.
 
This is part of the "save-face" strategy on Italy's part. They can now categorically state that she is a felon, while at the same time say that their hands are tied as to why she can't be "brought to justice".

It doesn't matter, she's already in the US and we won't extradite her back to Italy.

Also, I'm pretty shocked Italy doesn't have a "double jeopardy" law.... So basically in Italy you can be tried for a crime until you're finally found guilty???

Yes, they can appeal it all the way up to their supreme court, after that I think it's over. Their legal system is a joke, she was also found guilty of slander for talking negatively about the police and the legal system.

That's crazy.... I don't even know why people have a desire to go abroad. You could wind up in jail for sneezing wrong in some countries.

That is the risk anyone faces going to the US :) so why any different abroad :)

Will be interesting to read the reasoning behind it, but that wont happen for a while and until then I wont make any quick conclusions.

But saying that, just because there is a new case, then that does not mean that she will be convicted since the physical evidence is at best questionable. But I do believe she had something to do with the murder.. her behavior after the murder was not exactly normal for someone who is innocent.

Just don't get caught in NY with too big of a soda or LA with a plastic bag..

Sooner or later they will start attacking those that consume instead of those who meet demand then we will all end up in jail (not that we already aren't).

Or walking over a street.. jogging at in a hoody while being black and so on and so on. And the best part it starts even before you get there, with the personal intrusion of the US state into our financial and personal affairs and then there is of course the border police staredown of hate at various US international airports. It is almost as if you guys dont want people to visit you..

And dont worry about a "too big soda" or plastic bags.. we have similar rules for a long long time in Europe :).. well not with the too big soda, but then again we are not use to those sizes here so /shrug.
 
I am not sure this is anything like double jeopardy, in several countries it is possible to appeal a guilty or innocent verdict in which it remains the same case but is bumped up to a higher court. That is the norm in some criminal law court systems. In the Netherlands one can be found innocent in a lower court, the DA thinks the judge made a mistake and appeals the decision in which a higher court will try the case on appeal. In the Netherlands one can then appeal that higher court verdict one more time to go to our version of the supreme court called "de hoge raad" (or the High Council) in which the case will not be tried again like in the first appeal but the high council will review if the law has been applied correctly in the case before it. If they feel that the rights of the suspect were violated they can send the case back to the lower court and then the trial has to be redone taking into consideration the ruling of the high court.

Fact is, that it is still the original trial, even if it is the appeal trial, so that means that if this happens, there is no double jeopardy


The High court can do more, it can reverse earlier finale decisions of any court. If there is a case in which later evidence proves that the person who was convicted in fact is innocent (grave judicial mistakes) they can order the new trial for the suspect.

Government needs to do their job - protect their country - not protect people from plastic bags or attempt to prevent them from becoming fat or earning a "Darwin Award."

In a free country it's none of the governments business what people do.. If people want to eat a 5 pound bucket of french fries so what? If a business wants to put their product in a plastic bag then so what?

In what flipping universe is it anyones business if someone is fat or consumes too much? Of course the same people that cry about that will turn right around and claim it's no ones business if a woman has an abortion or it's no ones business who screws who and who marries who.

Big government can go piss off and so can nosy people... People and government spend more time worrying about what others are doing than what they're doing. That creates a dysfunctional society.
