And dont worry about a "too big soda" or plastic bags.. we have similar rules for a long long time in Europe .. well not with the too big soda, but then again we are not use to those sizes here so /shrug.
I am not sure this is anything like double jeopardy, in several countries it is possible to appeal a guilty or innocent verdict in which it remains the same case but is bumped up to a higher court. That is the norm in some criminal law court systems. In the Netherlands one can be found innocent in a lower court, the DA thinks the judge made a mistake and appeals the decision in which a higher court will try the case on appeal. In the Netherlands one can then appeal that higher court verdict one more time to go to our version of the supreme court called "de hoge raad" (or the High Council) in which the case will not be tried again like in the first appeal but the high council will review if the law has been applied correctly in the case before it. If they feel that the rights of the suspect were violated they can send the case back to the lower court and then the trial has to be redone taking into consideration the ruling of the high court.
Fact is, that it is still the original trial, even if it is the appeal trial, so that means that if this happens, there is no double jeopardy
The High court can do more, it can reverse earlier finale decisions of any court. If there is a case in which later evidence proves that the person who was convicted in fact is innocent (grave judicial mistakes) they can order the new trial for the suspect.

In a free country it's none of the governments business what people do.. If people want to eat a 5 pound bucket of french fries so what? If a business wants to put their product in a plastic bag then so what?
In what flipping universe is it anyones business if someone is fat or consumes too much? Of course the same people that cry about that will turn right around and claim it's no ones business if a woman has an abortion or it's no ones business who screws who and who marries who.
Big government can go piss off and so can nosy people... People and government spend more time worrying about what others are doing than what they're doing. That creates a dysfunctional society.
