Well the supremes got this one right and bitch slapped this radical environmental group in the process. Alot of us in the industry are breathing a huge sigh of relief.

WASHINGTON — The Supreme Court on Wednesday sided with timber interests in a dispute over the regulation of runoff from logging roads in western forests.In a 7-1 vote, the court reversed a federal appeals court ruling which held that muddy water running off roads used in industrial logging is the same as any other industrial pollution, requiring a Clean Water Act permit from the Environmental Protection Agency.

Glad to hear it. Seems even most of the Liberals on the Court thought that one went too far. What was EPA going to do next, go after people with dirt driveways?

Yep. And after that, they are going to require an emissions control unit in each pair of underwear as part of their mission to control air pollution. The agency is totally out of control and in need of serious restraint. I read Breaking Point yesterday - a fun novel about EPA gone wild.

It is a pretty freaking sad testament to the uselessness of the EPA if this is what they are doing and it is taking the SCOTUS to check them on it.

I should have been more clear in my OP, just because I know something I assume everyone does but I forgot this issue has only been followed by a small group of environmentalist and people in the timber industry. For once the EPA is not the culprit here, a small and radical enviro group, the Northwest Environmental Defense Center filed this suit and won in the lower courts and the ninth circuit upheld it. If the supremes had upheld the ruling the enviro group could then sue the EPA and force them to implement the new water designation for logging. Since the EPA has already tried once to regulate storm run off the suit would probably not be necessary but it sure would have given them cover. Anyway alot of us were really sweating this decision and I was heartened by the near unanimous decision, WHEW!

Of course the 9th upheld it! There is no more liberal, left-wing group in the world.
