After watching the film, which depicts the political fight to pass the 13th Amendment, Batra did some research. He learned that the amendment was ratified after three-fourths of the states backed it in December 1865. Four remaining states all eventually ratified the amendment -- except for Mississippi. Mississippi voted to ratify the amendment in 1995 but failed to make it official by notifying the U.S. Archivist.

There was also a state... Louisiana I think, where inter-racial marriage was banned according to their constitution... which was first removed barely a few years ago in a referendum... the change only squeaked by.. wtf?

This has nothing to do with the federal government. This is a Tenth Amendment issue.

They are both part of the same federal constitution, one amendment just happened to be added latter.

In some people's interpretation of the Constitution, EVERY Amendment is secondary to the 10th. What they fail to recognize is that when the Constitution is amended, it changes, and what may have been previously not a Federal power is now given to the Feds.

I presume that he meant that a under the 10th Amendment, slavery was not regulated by the Federal government. BUT, the 13th changed that. So it's not a 10th Amendment issue anymore, because the 13th gave that power to the Federal government.

But you'll never convince a self-described "libertarian" that their interpretation of the Constitution is wrong.

Easy now. You can't just rush into a big decission like this. You have to take your time and make sure you cross the T's and dot the I's.

How could I have not read the post since I replied to it?

I would love to know what the Tenth Amendment has to do with the Thirteenth Amendment?

One is state rights to self-legislate and the other is slavery.

If you're willing I'm willing to debate both and show that both are entirely different ideas, not only that but I can elaborate on how and illustrate the background and reasoning behind the manifested ideas.

No, everything after the Tenth Amendment violates the Bill of Rights... None of it is legal.

State rights are supreme - if those liberties weren't, then the Tenth Amendment wouldn't exist.

If there were actual slaves in Mississippi, then I could see the OPs point.

I challenge you to find a single instance of jurisprudence in the entire history of this nation that supports this position. Otherwise, you cannot claim that your positions are factual, only that you wish they were.

Also how in the hell do you get the notion that the Tenth Amendment nullifies the amendment process and precludes any further amendments?

it matter not if Mississippi ratified it on day 1, ratified it years and years later... or never ratifies it.....

it changes nothing.
