    New Mexico teen accused of killings of parents, 3 children

    ALBUQUERQUE, N.M. (AP) — A horrific scene awaited officers responding to an emergency call at a New Mexico home — five family members dead, all with multiple gunshot wounds. The victims were later identified as parents and their three young children and the suspected attacker as their 15-year-old son.

    Authorities declined to release details of any conversation that the 15-year-old had with investigators, but they said he was the Griegos' son. The sheriff's office said he is charged with two counts of murder and three counts of child abuse resulting in death.

    Shooting a child multiple times is not murder, but "child abuse resulting in death?" Is that only in New Mexico?

    The fact that the 15 year old suspect's name was used in the story indicates that he must be being charged as an adult, since the name of the accused minor is usually not released for juvenile justice charges. Not sure about NM law but maybe child abuse resulting in death has different sentencing guidelines than murder II, or makes it less likely that the sentences will run concurrently if different charges are used for some of these deaths.

    Yeah my guess is it is two fold--the death by neglect will have different elements so it is like a safety net in the prosecution in case something goes totally wrong at trial or on appeal on the murder charges (sometimes prosecutors will hold back charging in all the deaths at once in order to be able to bring additional charges if the first cases fail for some reason due to double jeopardy); and as TTWTT said, it also may be so the sentences will run one after the other instead of simultaneously to increase the likelihood the guy will never get out of jail.
