It was not a conspiracy only because that requires two people communicating together. If this journal was a joint collaboration, or was a means of communicating between 2 accused it is likely to be a lot easier to prosecute.

As for the charges in question, here is the basic theory for attempted assault. For AL I believe that would be this particular charge.

Possibly, yet that required the action of the teacher as well. Simply writing down a "plot" in a priavte journal did not place anyone else in fear. Only the release of that journal or publishing its content, to include the names of the specific targets, could place them in fear.

Not at all. You should be required to buy a round for the house as an idiot penalty. Now, if you walk into the bar with a baseball bat and yell "Luther, I'm going to kick your ass" that's a different story as you have obvious intent and means to harm a specific target.

This kid had apparently laid out a plan, selected targets and started to assemble the means to carry out his plan. If Tim McVeigh had been stopped at that point we wouldn't have had the Oklahoma City event.

It's MUCH better to nab the little freak now before someone gets hurt.

No offense, but I could leave the bat and have obvious means to harm you.

That may indeed create difficulty getting a conviction. But:
1) We do not have access to the full case at this point. What lead to the discovery of the material by the teacher. If this student said anything, or communicated non-verbally, for example that indicated a threat and lead to the discovery. Or if he had the book in question open in class or another public display of it. *shrug*
2) The alleged physical actions taken to assembling the bombs, if accepted as such by judge/jury, would demonstrate his intent and an attempt at the assault where-upon his legal goose is cooked.

Maybe, but a misdemeanor conviction of a minor is nothing, compared to an involutary commitment to a secure mental health facility, which is what I would prefer (from what I know of this case). ;)

As I mentioned, even if he did have everything he listed, he couldn't make a worthwhile bomb. So how about if I went into the bar with something that may not kill or maim, but perhaps sting a bit and maybe hurt a little while...like a broomstick.

Far as I'm concerned, this kid could've said that he was going to burn their eyes out by pouring Dr. Pepper on them.

This is mind-crime and while this kid needs a spanking, he doesn't need a felony. We're too fast to convict and condem (IMHO of course).



There is absolutely no reason to be sympathetic to this guy. For Gods sake...they managed to PREVENT a moron from at least attempting to kill 7 people (and whoever else may have been around them). Lets count this a win and throw the little sonofabitch into a cell with some new best friends...30-40 years sounds about right. And then lets make his life in prison a reality show so any other little jagoff contemplating such behavior might have real second thoughts about it. Get off the train to namby pamby land. Actions have consequences. This kid should be hit with every possible charge they can make stick.

That's not accurate. The news articles I read quoted experts that stated with gunpowder and fuse, they would have done precisely what he thought they would do. What we have (and it is mind numbing that people are defending the little ****) is a guy that plotted to murder at least 7 people that was caught before he was able to complete the act and you people are acting like he is the victim.

If Dylan Klebold's parents had simply opened his bedroom door and seen pipe bomb components and weapons strewn around the room, along with written plans to slaughter as many classmates as possible, does anyone honestly think they should have just closed the door, shrugged, and said, "Until he actually kills somebody, he hasn't committed a crime?" Hell, no! The very act of planning to kill someone is a crime. If a person tells his/her psychiatrist about plans to murder someone or commit a massacre, that psychiatrist is legally bound to report it to the police. Why? Because it's a freaking crime, that's why!!

I was thinking about this as well. At what point should police intervene? This was not just a teenager saying he was going to bomb several people. He had specific targets, a plan of attack, and even began the construction of explosive devices.

And a good case could be made for taking him in on suspicion. But at this stage of the game they really shouldn't have posted the kid's photo or even his name. They need to make sure the kid is a danger first before they lay that lifetime marker on him.

Newsflash to the idiots in our country . We have a zero tolerance for any suggetion of bombing or shooting up school students.
Just like after 9-11 you don't even jest about carrying a bomb onto a plane.

He may have just been blowing smoke but I am not willing to wait and watch.

Tarasoff doesn't indicate that a patient will be automatically charged with a crime for stating intent to commit harm to a specific person with specific means. It does require the police and individual be notified and surely the police would interview with the patient and charges might be in order based on that interview.

Its amazing to me. This guy wrote his plan and an investigation found he was acting on his plan. He planned on killing people and luckily it was stopped before he managed to hurt anyone. I don't KNOW the individual...I'd prefer to lean on what we know....but what we know is there is every indication he had every intention to kill people. WITHOUT knowing **** about the little asshole people are dismissing it...pooh poohing it. Oh...it was just hijinx. No charges. Whats the big deal anyway...I mean really...poor widdle misunderstood widdle guy. WTF...we HAVE to either catch them IN the act or AFTER the fact apparently.
