    Common sense would agree with that position. Private enterprise should in no way be obligated to do business with anyone they choose not to. If public funds are involved then it is another matter. Once the state determines what you, as a business person can do in offering your services or goods, you no longer are involved in free enterprise.

    May Judge Bork rest in peace.

    Having had the privilege of meeting him while in Washington, I can certainly attest that he was a first-rate intellectual. One need not agree with his ideas, judicial philosophy, or writing to recognize the caliber of his intellect. Moreover, I don't believe it is constructive to personalize disagreement on ideas. The limits of such disagreement should stop with the ideas, not contaminate personal relationships. Otherwise, one's personal relationships wind up more sterile and less interesting than could otherwise be the case. Diversity of thought can be intellectually stimulating. Personalizing disagreement over ideas deprives one of access to such diversity of thought.

    too much of an ideologue to be considered for SCOTUS. i don't have any desire to speak ill of the dead, though. it has pretty much all been said already.

    My issue with Bork was not the way he was treated, although I felt he could have been treated better. I agree that he should not have been confirmed to the Supreme Court because, as a member of the Nixon administration, he was the one who fired Special Prosecutor Archibald Cox, during the infamous "Saturday Night Massacre" that ended the investigation (temporarily) into Nixon's criminal activities surrounding Watergate. So, instead of upholding the Constitution, as he had sworn to do, Bork assisted in helping the Nixon administration obstruct justice. And for that reason, rather than reasons of ideology, it was proper to shoot down his nomination to SCOTUS.
