    Wis. judge strikes down law crippling public unions

    Its not over of course...Im sure it will be appealed...but these court cases will go on until next election at least


    A Wisconsin judge has struck down the politically divisive state law that gutted collective bargaining rights for most public workers, the Associated Press reports.

    Dane County Circuit Judge Juan Colas ruled today that the law, which was championed by Gov. Scott Walker and Republican lawmakers, violates both the state and U.S. constitutions. AP writes that it wasn't immediately clear whether the law was suspended immediately.
    Unions representing Madison's teachers Milwaukee city employees had sued to overturn the law. Walker survived a June recall attempt driven by unions.

    Very good news. With this and the Chicago strike happening, it looks like the initial push by government to screw with unions is being met with quite a powerful resistance. Hopefully, that resistance will be able to sustain itself.

    It will be appealed. THe supreme court has already overturned another Dane Country judge that attempted to stop it, they will almost certainly do so again. As I recall, last time they appealed it and got a quick decision... I would guess they will (if possible) probably do the same thing.

    How many bites at the apple they going to try to take. This judge should be yanked from the bench PDQ. Should be charges filed against him with the state judical ethics board.

    why? for making the correct judicial call

    Does this ruling mean that all employees who chose not to pay union dues will now have them deducted anyway against their wishes? Again? If so the unions are just creating more enemies.

    It's not the "correct judicial call", that's the point. Already been decided by the SCOTUS and recently (the final word on the matter in his universe). He's trying to jump branches and veto legislation from the bench. That's cause for an judicial ethics hearing.

    Judge strikes down Wis. law limiting union rights - Houston Chronicle

    A Wisconsin judge on Friday struck down nearly all of the state law championed by Gov. Scott Walker that effectively ended collective bargaining rights for most public workers.

    Walker's administration immediately vowed to appeal, while unions, which have vigorously fought the law, declared victory. But what the ruling meant for existing public contracts was murky: Unions claimed the ruling meant they could negotiate again, but Walker could seek to keep the law in effect while the legal drama plays out.
    I think that chances are good that this ruling will be overturned on appeal. It doesn't make sense that the state can grant rights to unions through legislation but then can't take them away through legislation.
