Joe Arpaio Investigation Closed; No Federal Charges Will Be Filed Against Him
PHOENIX — Federal authorities said Friday that they're closing their abuse-of-power investigation into Maricopa County Sheriff Joe Arpaio in Arizona without filing charges against him.
Authorities were investigating America's self-proclaimed toughest sheriff for his part in failed public corruption cases against officials who were odds with him. Arpaio brought cases against a judge and two county officials in 2009.
Federal authorities also decided to not prosecute matters tied to alleged misuse of county credit cards by sheriff's officials, alleged misspending of jail-enhancement funds and other matters.
"They did their investigation, they didn't find enough probable cause and they didn't bring an indictment," Arpaio said at a hastily called news conference after returning from the Republican National Convention in Florida. "We don't go around framing anybody. My people are not crooks."
Assistant U.S. Attorney Ann Birmingham Scheel released a statement saying her office "is closing its investigation into allegations of criminal conduct" by current and former members of the sheriff's and county attorney's offices.
Scheel, who is based in Arizona, said she was acting on behalf of the U.S. Department of Justice. In a four-page letter to Maricopa County Attorney Bill Montgomery explaining the decision, Scheel wrote that "our limited role is to determine whether criminal charges are supportable. After careful review, we do not believe the allegations presented to us are prosecutable as crimes."
"I've been in law enforcement for 50 years. Nothing surprises me. But I know my people did the right thing," said the 80-year-old Arpaio, who is running for a sixth term as sheriff in Arizona's most populous county. "I'm just happy for my organization, for my deputies. Not for me."

Also not suprised that Wilcox and other pro illegal alien supporters are dismayed. Wilcox now says she has no faith in the DOJ.

Now, hopefully the civil case on profiling will have the same results.
 
All that aside, the guy's a fascist and a racist. That unfortunately isn't against the law. However, since this is Arizona I expect he'll be the next Governor once Crazy Jan decides to hang it up. You can never go far wrong in Arizona by bashing hispanics.

Do you have any evidence that Joe Arpaio is a racist and a fascist? Or is this more the pro-illegals waa boo hoo we don't like him enforcing laws so we make up lies about him?

I'm just surprised because there seem like so many other things that he appears palpably guilty of and this was the tamest of his alleged crimes and transgressions. I'd like to see him taken down.

The civil trial might be more trickier. Guilt in a civil trial is determined by by the preponderance of the evidence,which essentially means that it was more likely than not that something occurred in a certain way.Guilt is a criminal trial means guilty beyond a reasonable doubt. Pro-illegals will probably argue that since illegals are brown that there was a more likely than no that Joe racially profiled without any actual evidence to support their claim.

Not prosecutable =/= didn't happen.

Note that they did NOT say the allegation were unfounded. They did NOT say there was no evidence anything illegal actually happened. They merely said that the case would be unwinnable. Decisions are made everyday regarding the practical feasibility of a given case, and Sheriff Joe's popularity and status only serves to make him even more of a "persecuted martyr" if they were to proceed and lose.

This was a practical decision, nothing more. Certainly not a vindication.

Right, Mike, I was responding more in general than to you.

As far as I am concerned you can't get much more political than Mary Rose, Joe Arpaio, Jan Brewer, Russell Pearce, Thomas and the rest of those bastards. All things being considered, you know who I liked, Jane Hull. She wasn't perfect but she kept the state on an even keel. Napolitano was pretty damned partisan. Hull seemed to be able to keep the lid on most of the extremist nutters.

We need guest workers under a quest worker program. Both sides would benefit.

I don't support illegals, but I do believe that we have handled the issue most poorly.

As to MCSO, I've traveled all over the state for many years and no one has stopped me and asked me for ID except when I have been speeding, which has been more often than I care to admit. :mrgreen: But I'm obviously a white guy. I'm a white guy with a Georgia accent. Most people (incorrectly) assume that I support unequal treatment of legal American citizens. I don't support that.

I can agree that over many years the US has handled the illegal alien issue poorly. Border security, improved guest worker program, more stringent laws and fines for employers who hire illegal aliens, needs to happen.

It is fine line that law enforcement needs to follow when it comes dealing with illegal aliens from Mexico and legal aliens or US citizens with Mexican heritage. What I dislike is some who jump on LE and scream racism, when that many times is not the truth.

Like you my line of work (now retired) had me traveling all over the SW and the US. I dealt with Native America fire crews, fire crews made up mostly of hispanics, etc. My point, many of MCSO "sweeps" were done on businesses where other issues (ID theft, etc) was reported to be happening. It will be interesting to see how the civil case pans out against MCSO.
