    Did you misread Title IX? Here it is again: "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

    It doesn't say "It's OK to do it to some people, as long as you don't do it to everyone."

    Agreed. The ACLU doesn't seem to be approaching this from a Fourth Amendment angle (yet), but I think you're right that this would constitute an unlawful search and seizure, in addition to the other legal problems with it.

    So a school can’t kick me out for drilling a peep hole into the girl’s locker room because that would violate Title IX right?

    Wow, this is terrible. It's a blatant violation of Title IX and it's gender discrimination, pure and simple. And it's made worse by the fact that this is a PUBLIC charter school in Louisiana.
    My first reaction to this was.... what the f***

    Second... I hope the ACLU goes after them.

    Third.... how does this benefit anybody at that school in terms of education or getting into college? I see no practical, rational reason for the school to be doing this, other than judgement and ignorant fear that pregnancy spreads around like the gay or something.

    Maybe the people running that school are too ignorant to be educating...

    If a school allowed lesbians to use the peephole but banned you for the same behavior, it would be a title IX violation. That doesn't change the fact that discrimination based on pregnancy is most definitely a title IX violation.

    And to any of you pro-life conservatives who are defending the school here: Have you considered the likely consequences that this will have on abortion rates? If schools decide to ban pregnant teenagers and make their lives even more difficult than they already are, you're probably going to see more abortions.

    Not that I think very many "pro-life" people really care about abortion, except for political reasons.

    You have decided this is about “gender discrimination” because only women can get pregnant. Title IX doesn't apply here because discrimination against all women isn't occurring, only discrimination against an act of irresponsible behavior. If there was any way for the school to determine who the father was, I’m certain the school would expel the father as well.
