    They arent allowed to attend school while pregnant. They may continue in a school provided home curriculum if they choose and may return after they have had the child. The school (as a school of choice) has the right to refer the student to a doctor for exam.

    It is a school of choice. The students/parents agree to the rules before being allowed to attend. Nothing in the US Constitution preventing this. Partial federal funding does not make a difference because it is a school of choice.

    BTW, where are the references to the state and it's actions to any complaints that were filed? Did they go straight to a lawsuit without addressing concerns to the state and giving the state a chance to take action? What concerns were brought before the school and what actions did it take prior to the lawsuit?

    They haven't filed a lawsuit yet. The ACLU just told the school to cease and desist or they WILL be filing a lawsuit.

    Title IX states "No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance."

    It doesn't say anything about a "school of choice" being an exception. For example, every state university in the country is a "school of choice," yet they are all subject to Title IX. There's no reason a public charter school would be any different.

    What the school did was illegal in addition to being immoral. The Gruenke v. Seip case established it was a 4th amendment violation for a coach to demand a girl take a pregnancy test.

    School pregnancy test violates student's privacy rights - Gruenke v. Seip, 225 F.3d 290 (3rd Cir. 2000)
