    Yeah, this is a change I've not relished, the loss of a private life. However, this case has more to it. The guy was at the board of directors level. He has a fiduciary duty to the company even in his off time. Dragging the company into a national dustup could very well hurt the company's imagine, and thus their bottom line.

    He lost the private life argument the moment he posted the video to the public.

    Do you think the guy has (or should have) a legal case about it?

    There's a difference between wanting/having an outside life and actively seeking attention to yourself that will embarrass others who associate with you. I would be not helping my job security if I go out in my small town and becoming blackout intoxicated in public all the time. It's my private life, sure, but my company has a right to minimize the employees on the payroll who have poor judgment and purposely attract negative attention to themselves. Maybe in theory doing stupid stuff like that all the time "shouldn't" result in losing my job and my wife divorcing me, but they both have that right and it shouldn't be entirely unexpected. This guy has his freedom of speech, his (ex) employers have their freedom of association.

    I don't necessarily think that he has a legal case. But with the continued evolution of social media and such, I think we're gonna need to start adding in some protections.

    I dont think we need more government or legal interference with businesses. A business should be able to decide who they want to hire and fire without government interference.

    Just more rights I think is ok. The real problem is that if you type something on your facebook you boss doesn't like, they can fire you. But I'd say less they did it on company time or were revealing company secrets, or something else which involves the company; then it's none of their business. Because monitoring and databasing have aggregated to such staggering levels, we're likely going to have to expand on our explicitly stated rights in order to regain some amount of freedom.

    At will hiring. The more the government keeps telling people/businesses who they can and cant fire or hire the closer we are moving to government control. Actions have consequences and people need to accept them.

    Indeed, that is a problem. But even with protections, this guy would still fall outside them. He was a CFO, he has additional duties to the company that are not shared by the rank and file.
