this is rediculous. the theater/movie producers/holmes drs are not responsible for what this kid did. He is. Noone else but him. more frivolous lawsuit to continue to mess up america. i am going to counter sue this idiot for forcing a court system to waste my tax dollars listening to him
 
Might as well sue his parents, and the school for not doing anything, and the police for not responding fast enough.
 
the local news is raising questions about whether this mope had some help. some one is claiming there were two CS grenades from two different locations.

sue the theater for allowing him to go out an emergency exit and come back in with no one knowing about it

sue the theater for being a "gun free zone" or the city for not recognizing state issued CCW licenses

and sue the gun manufacturer, the bullet manufacturer, holmes neighbors, the govenor, the guy working concession, the architect who built the theater near an alley, the original creator of batman (or his kin) barrack obama, and george zimmerman too.

I checked around since I live near one of those mega theaters. every screen room has a rear exit, in some cases-the last show of the night, the lights are turned on, and an usher opens the emergency doors so people can exit directly in the parking lots without having 10-16 rooms all emptying out into the lobby at about the same time

but during the theater those exits are alarmed-the thought being if someone could open the door without security knowing it, one guy could buy a ticket and then open the door and let a bunch of people get in-without paying.

while I doubt the guy could have been stopped if he came in the main entrance looking like Rambo's wet dream, the PO PO would have been notified far quicker and when I have been to theaters, there is usually security-often on duty cops or ones working a private detail in uniform, especially the late night shows even in the prosperous suburb that theater is in

there is no law that states an exit has to have an alarm. they have no responsiblility other than an exit to all people to exit with single motion egress in the event of an emergency.

I'm not surprised. They have to prove that the theater did something wrong and, in my mind, that won't be hard. As your link says, that emergency exit (like all the ones I've ever seen here in Illinois) ought to have had an alarm on it. That it didn't allowed the shooter to leave by the exit door, prop it open, go out, get dressed, arm himself, return and start shooting. I hope they have good liability insurance or they'll just go out of business and nobody will get anything.

I do think the theater should not have a door going out that wasn't alarmed or had a notification system or a flashing light or something. well I believe before they sue anyone the organs of the killer should be sold off to hospitals for transplants and use that money for the victims

Theater exits are not rated as "emergency exits". Sorry, but they are not. They are available to be used as a regular exit.

However, many theaters have them wired into their main alarm system, for when they lock up after closing, with a simple magnetic switch on a circuit. Further, many have it such that when any of those doors is opened, it is signaled in the main office, and elsewhere. Such usage is expected, albeit briefly, at the end of a show. But not during a show, and even less, to be propped open for minutes. If the theater has a protocol, and it was not followed, due to being short-staffed, goofing off, etc., they could face liability. Not allowing folks in the back, thusly compelling all in through the front, is part of basic security in a theater. Ignoring their own alert system would be a breech of that.

But it is not an emergency exit. They are not labeled "an alarm will sound", etc.

I always thought that there should have been better security to make sure he didnt walk in and out. I couldn't imagine if the doors were locked and he couldn't enter, and they should have been.

BTW... how did he enter the room? Was he behind people and shooting, or did he enter from the front, the middle?

Yes, because having an alarm on the escape door in the cinema would have stopped this tragedy. Idiots like him could have always found a way to enter into that cinema. For the good of it, he should also add that it was a disgrace they did not have armed security standing watch over that door to make sure no armed idiots could come in and kill people :roll:

And blaming the movie? Why do you think he himself was there? To enjoy the movie, with all the violence in it.

This person is the prototype of a leech of society.
 
I think it is absolutely ridiculous to hold the theater responsible in any way. I think there should be a law quickly passed preventing businesses from being sued for the actions of lunatics.

I don't agree that the theater has an obligation to make its premises safe from murderers. Does a restaurant? Does a shopping mall? And so forth. God how stupid!!!
 
If the man was injured himself or if his child/father/mother/brother/sister/significant other had been killed he might have something to sue about but he wasn't injured and it was just a friend that had died.

Now that will also have been tragic but there is only 1 party that was to blame for this tragedy and that was the shooter.

One of my daughters was in a theatre on a saturday afternoon...there was a fire in the theatre...and everyone went out the side exit no problem...a few days later a law office calls the house and I was told my daughter could be entitled to compensation and that I should contact the office for an appt...I politely told the woman If I decided to sue I would contact a real lawyer...

Im not saying that happened this time...but if you dangle a HEY YOU CAN MAKE SOME MONEY sign in front of most people...they will start waving it

The Theater did nothing wrong, neither did the film studio. I hope this suit fails in court. It's a waste of time and as another poster said, tax dollars.
 
If we start turning on ourselves like this, it just means the lunatics are winning, and normalcy is losing.
