As far as the law goes, the apartment is his home. He is leasing it. Had he survived the encounter - and guns were indeed prohibited in the apartment - I suppose they could have evicted him for breach of contract, but a line in a lease agreement doesn't take away your right to self defense.
But they were not on his property in the middle of the night. If he was pointing a gun at them and they technically were not on his property or advancing into it before he pointed it at them, then he technically wasn't totally defending his property because he didn't know what threat they really posed. If he saw that they had weapons prior to opening the door, then he should have called 911. If he just opened the door to them with gun aimed at whoever was there, then he wasn't defending himself as he was just threatening the person right outside his door. He had no true way to know the knocker's intention when he opened the door, so his proper response should not have been open the door, aiming a gun at whoever was out there. Either leave the door closed and ask for identification and/or call the police or, if you feel truly brave, open the door with gun in hand but not aimed at whoever is on the other side.

Sigh, I hate to hear stuff like this...such a shame....I dont know about anyone else...but right next to my door there is a combat shotgun...and a million vote stun gun...for god sake LOOK whos at your door before you open the damn thing...I always do...why would you just answer your door pointing a gun at whoever is standing there...what if it was a 10 yr old selling school candy....I have to believe if this guy looked and saw two cops at his door he wouldnt have done what he did

I was thinking what if it were a person trying to get help for something and they were a bit hysterical and that startled the guy into shooting them. It just doesn't make sense to me to open your door with your gun pointed at whoever is on the other side. IF you feel threatened, then just don't open your door at all and call the police. At the very least, ask who is out there.

Something has been nagging me about this and I couldnt put my finger on it, till just now....if this guy opened his door with a gun pointed at the cops....they had to unholster bring the gun up an shoot him...he had plenty of time to pull the trigger and at least shoot one cop...
Either this guy was just a dumbass and had no intention of ever pulling the trigger...or he saw they were cops and paused, but if he did all he had to do was OH WOW SORRY and aim the gun down and they would not have killed him.....or he knew there were cops at his door and this was suicide by cop...but something isnt right about this...

The cops were wrong with the information we have. The guy's motorcycle was parked in front of that door, so they assumed he lived there. Well, wrong. The mistake the guy made was opening the door. Yet, if he hadn't? The coppers might have kicked it in. Same result. He's got a gun. Somebody(ies) die.

It was an accident. But they were most certainly wrong. And an innocent man (from all accounts) is dead.

    Florida. Sound familiar?

Why didn't they just stake out the motorcycle? Ask the property management company which apartment he lived in? Why make such a huge assumption at 1 AM?

I seriously doubt the coppers just knocked on the door. We'll never know. That blue line thingie and all.

@ lpast -- I agree with you. Something doesn't seem right about this incident.

Ever hear of backdoors and windows maggie....yes they made a mistake, no one has denied that I dont think.....His mistake was NOT answering his door...his mistake was answering his door and having a gun pointing at two cops...that would be a mistake no matter who was at the door...

Why wouldn't they have their guns unholstered and pointed at the door when they knocked? They believed they very well may be facing an armed suspect. It would make sense that they would have their guns ready should the guy attempt to shoot them.

Them going to the wrong house was the entire cause of the shooting. It's entirely their fault.

    that's asking to die.

If the cops had identified themselves this probably never would have happened. What I find interesting is the amount of people in this thread who seem to find no culpability with the police, especially given the circumstances.

Now, if the guy was pointing his gun at the floor, then they likely would have told him to "drop your weapon".

It is possible that they shot the guy without provocation.

Honestly, unless more info comes out, I will give the cops the benefit of the doubt. I don't think more will come out, considering the circumstances of the incident though.
Sure, why not, shoot first and ask questions later. It isn't OK, even when the police do it.
