The weapons weren't allowed to illegally cross the border. Thanks to Arizona's insanely lax gun laws, ATF had no legal grounds to interdict them.
The tactic of letting guns walk, rather than interdicting them and arresting the buyers, led to controversy within the ATF.[5][33] As the case continued, several members of Group VII, including John Dodson and Olindo Casa, became increasingly upset at the tactic of allowing guns to walk. Their standard Project Gunrunner training was to follow the straw purchasers to the hand-off to the cartel buyers, then arrest both parties and seize the guns. But according to Dodson, they watched guns being bought illegally and stashed on a daily basis, while their supervisors, including David Voth and Hope MacAllister, prevented the agents from intervening.[3]
As a result, this report tells the story of how misguided gunwalking operations originated in 2006 as ATF’s Phoenix Field Division devised a strategy to forgo prosecutions against low level straw purchasers while they attempted to build bigger charges against higher-level cartel members. Unfortunately, this strategy failed to include sufficient operational controls to stop these dangerous weapons from getting into the hands of violent criminals, creating a danger to public safety on both sides of the border.

This is silly. F&F was a monumental ****-up of unprecedented proportions. Heads should have rolled on that one, even Holder's. Obama should have fired him on the spot. Although Holder should have lost his job over this fiasco, he should not be criminally prosecuted.
Issa is a power-mad politician looking to get his name in the history books the only way he knows how... by blowing a complete screw up into literally "a federal case" uring an election year.
Holder is just a bumbling, underqualified asshole... like all too many high-level political appointments.

Of course it's the presidents prerogative to invoke EP, just as it's Congress' to try to overreach. Ultimately they either work it out or the courts decide.

He had the right to hold congressional hearings on the matter. However, the way he conducted himself as chair of those hearings left much to be desired. :lol: Once Obama invoked EP, I think he basically threw a major temper tantrum and was determined to regain control.
I predict Holder will never see the inside of a courtroom. Once November has come and gone, this will IMHO quietly drift away. Meanwhile, Obama not only screwed the pooch by not cutting Holder loose after the F&F fiasco (I mean, what the hell was Obama thinking??), he has now attached Holder to his own left hip because he cannot effectively replace him now without making himself look like a completely ineffectual and indecisive leader.
Not that I care what happens to Holder, mind you. I just think with wars, rumors of wars, in the middle of a global fiscal crisis and our own economic depression, it pisses me off that congress is less interested in passing legislation to stimulate jobs and the economy rather than spending millions going after a second-rate cabinet head.

Well, the House passed a bill right after the contempt vote to try him in civil court vice criminal court. That allows them to hire a special prosecutor and avoid using a US Attorney. A smart move IMO.
