House moving to hold Holder in contempt
Boehner has enough of AG’s ‘excuses’

The House of Representatives is moving forward with proceedings to hold Attorney General Eric H. Holder Jr. in contempt of Congress — a major escalation in the separation-of-powers battle over “Fast and Furious,” the Obama administration’s botched gun-walking operation.
“The Justice Department is out of excuses,” Mr. Boehner said in a statement Monday morning. “Either the Justice Department turns over the information requested, or Congress will have no choice but to move forward with holding the Attorney General in contempt for obstructing an ongoing investigation.”

It's time to appoint a special prosecutor to get to the bottom of who approved what and when did they do it.
Criminally negligent manslaughter
Criminally negligent manslaughter is variously referred to as criminally negligent homicide in the United States, gross negligence manslaughter in England and Wales. In Scotland and some Commonwealth of Nations jurisdictions the offense of culpable homicide might apply.
It occurs where death results from serious negligence, or, in some jurisdictions, serious recklessness. A high degree of negligence is required to warrant criminal liability. A related concept is that of willful blindness, which is where a defendant intentionally puts himself in a position where he will be unaware of facts which would render him liable.
Criminally negligent manslaughter occurs where there is an omission to act when there is a duty to do so, or a failure to perform a duty owed, which leads to a death. The existence of the duty is essential because the law does not impose criminal liability for a failure to act unless a specific duty is owed to the victim.

There are one or more in the Obama administration guilty of omitting to act when they had a duty to do so. Law Enforcement officials had a "duty to act" as soon as they started losing track of the Assault Rifles in question. They did not. Jamie Zapata and Brian Terry were working to make this country safer. They were killed ostensibly at the hands of the very Government they were working to protect by guns that same Government was willfully allowing across the border into the hands of the murderers.
The responsible parties WILL be held accountable, if not by the ones responsible in power now, then by the next administration. This extreme injustice can not stand.
