    Drunk Driver Made to Wear Sign Saying He Killed a Man

    A *man from Houston who killed a man while driving drunk has been ordered to wear a sign saying, "I killed Aaron Coy Pennywell while driving drunk."

    Michael Giacona, 39, ran a red light* and hit 20-year-old Pennywell last June.

    Giacona spent 90 days in prison, but in addition to the prison sentence, Harris County Court-at-Law Judge Michael R. Fields ordered Giacona to wear the sign during four consecutive Saturdays from 9 a.m. to 5 p.m. at the scene of the crime.
    How is this NOT considered "cruel and unusual"???

    There is plenty of precedent for judges using public shame as a form of punishment.

    "Cruel and unusual" is rather subjective, as I'm sure everyone agrees.
    Nobody who wins a war indulges in a bifurcated definition of victory. War is a political act; victory and defeat have meaning only in political terms. A country incapable of achieving its political objectives at an acceptable cost is losing the war, regardless of battlefield events.

    Bifurcating victory (e.g. winning militarily, losing politically) is a useful salve for defeated armies. The "stab in the back" narrative helped take the sting out of failure for German generals after WWI and their American counterparts after Vietnam.

    IMO, he got off light. 90 days in jail and a few Saturdays of public humiliation are nothing in comparison to willfully and knowingly making himself unsafe and causing the death of another.

    Umm he could have gone to prison for YEARS for vehicular homicide. He got 90 days. If YOU were in his position, which sentence would you rather get? Say, 5 years in prison...or 90 days in a local jail plus a few weekends of public shaming?

    I think the American prison system, with all of its cages and gang violence and sexual slavery, is far more "cruel and unusual" than a little public shaming...IMO we should see a lot *more* public shaming in lieu of prison sentences. But that's a topic for another thread.

    Personally, I'd like to see anyone who caused a major accident while DWI ought to have their car painted so it glows in the dark. At least we could all see 'em comin'.

    The 90 day sentence was insanely light. But, I still do not agree with a "scarlet letter".
