[h=1]Walker signs bill barring workers from collecting damages for employment discrimination[/h]MADISON — Wisconsin Gov. Scott Walker has signed a bill that prohibits workers from collecting damages in employment discrimination cases.

Under current state law, employees who prevail in discrimination lawsuits can collect between $50,000 and $300,000 in compensatory and punitive damages. The Republican bill blocks anyone from collecting such damages in employment discrimination suits.


The state Department of Workforce Development still could award an employee back pay, costs and attorney fees, however.


Democrats said the bill hurts women who might suffer discrimination in the workplace.


Walker signed the bill Thursday but announced the signing Friday. His spokesman said it was easier to include the announcement in a broader release, noting the governor signed dozens of bills over the two days.

This is over the top, in my opinion. This guy really has a set. You'd think he'd lay back in the weeds...

Seems you forgot to read the rest of the column which states people can still collect back wages, costs and attorney fees. Seemed relevant so I thought I would help you out.

I actually like this move, limiting excess profiteering for oftentimes wasteful and unnecessary lawsuits.

Once 'conservatives' thought capping punitive awards was the way to go and now this. When corporations profit in the billions and get fined a few million that seems outrageous, now they can discriminate and face a slight slap on the hands.

I agree with you. Punitive damages are meant to send a message: "People who do this are going to find it mighty expensive." Now, with just attorney fees (and probably capped to "fair and reasonable" at that), the message isn't being sent.

The danger here is that corporations will approach this conduct with the mindset that, "Well, if we get caught, we'll settle early and avoid extensive attorney fees." And the danger with that is that attorneys will be reluctant to take these cases to court.

I do think it's appropriate to cap punitive damages -- thinking of the "Hot Coffee McDonald's Case."

I can sympathize, but this is an entirely different class of cases. My own feelings are that it has become way too difficult to just fire someone. IMMHO, an employer should be able to fire you for any reason at all. This at least limits the frivolity that has turned much civil litigation into pretzels thse last 30 years. Very expensive cluster****s of liberal foolishness.

Libs don't like it? Tough ****. Become an employer, and then keep lard-ass employees on your payroll forever so that you can feel good about it.

Ruin a family's life? That's a little over the top. The guy needs to find a better job with an employer who's not a dick in this case... the guy getting fired is the best thing that could happen.

Really? A middle class man with a wife and two kids, only income in the house, loses his job in a weak job market...doesn't seem too over the top in today's world...

Really... If every middle class man with a wife and two kids who lost their jobs had their life ruined, bodies would be piled up on the streets from coast to coast. Like I said, in your scenario, getting fired is the best thing that could happen to that guy. And guess what - the guy gets another job, maybe not his optimal college educated primary job, but something that pays the bills. And the wife too. Kids go to mom and dads, or a friends, or a neighbors, or they have to go to day care (worse case)... but they make due.

Punitive damages should be curbbed in some cases; however, without them companies/people will not bat an eye since there won't be a punishment. IMO though it would be better to send the offender(s) to jail.

@ Maggie: the McDonald's hot coffee case was punitive award was actually warrented. The woman sued because McDonald's jerked her around after she suffered 3rd degree burns from the coffee. All she asked for was get medical expenses be paid, the temperature to be lowered and the lid to be sturdier (it poped off while she was parked and she want the one driving the car) they told her **** off. That "**** of"was why the jury levied such a harsh punishment.

The financial punitive damages don't cure the problem.....the punishment aspect should be the termination of whatever level of managers participated...
If the jerks are fired, that is putting the punishment where it belongs....
A lot of the crap that goes on at work would stop immediatelly if front line supervision weren't so eager to please upper management that they put their own jobs at risk.
Human Resources is not there so much to protect the lower level employee as much as it is there to protect the company from the stupiditiy of its own front line management...

Some of you think Walker is "the man"? Have you seen what else he has done? Everything else that he signed last week and did not announce until a Friday holiday? Walker is a weenie and a coward. If you like him so much you can come live here too.

Allow abstinence only education
