    To me, this is pretty messed up. Military should be allowed to speak their minds and give their opinions about what they are doing.

    nope. they give up that right, as far as their commander in chief goes, when they enlist. period.

    all members of the military do give uo their rights upon elisting.posting remarks about obama can be viewed as creating dissent among soldiers,which is punishable by ucmj.

    He isn't simply "speaking his mind", he is saying he will not follow the orders of the President of the United States. That is a political activity, which is not allowed by pentagon rules.

    Also to note, he was warned of this in 2010 and decided to disobey a direct order by putting the page back up.

    Simply put, the military has different laws and rules that are different than rules and laws for civilians.

    Actually, that's not true. The only regulation in regard to politcal activity, is that a serviceman can't make political comments while in an official capacity. If he wants to make a public comments, while out of uniform and off duty, then he has every right to do so.

    If this guys gets drumbed about, he needs to find a cracker jack lawyer and sue the living **** out of the government.

    Everybody seems to be on track on this. If his facebook page had 0 association with him being in the military, he might have a leg to stand on, but most likely not.

    The Marine Corps said Stein is allowed to express his personal opinions as long as they do not give the impression he is speaking in his official capacity as a Marine.
    When he said he would not follow the orders of the President of the United States, he was doing so in his offficial capacity as a Marine. He would lose the lawsuit.

    He was doing this from a government computer AND by saying he would not follow the orders of the POTUS, he is saying so in his offical capacity as a Marine.
