    Federal Judge Dismisses PETA Lawsuit Claiming SeaWorld Whales Are Slaves

    SAN DIEGO (AP) — An effort to free whales from SeaWorld by claiming they were enslaved made a splash in the news but flopped in court Wednesday.

    A federal judge in San Diego dismissed an unprecedented lawsuit seeking to grant constitutional protection against slavery to a group of orcas that perform at SeaWorld parks, saying the 13th amendment applies only to humans.

    U.S. District Judge Jeffrey Miller stopped the case from proceeding two days after he became the first judge in U.S. history to listen to arguments in court over the possibility of granting constitutional rights for members of an animal species.

    Getting constitutional rights for animals is all about future litigation. If they accomplish that, they'll be able to sue for all kinds of things. PeTA is nothing more than money-grubbing lawayers. They don't give a wit about animals. I'm pleased that the judge shut the door on them.

    I can see their position. If the courts are willing to give a paper entity Free Speech rights then it would be a good time to try animal rights as well. I'm glad this one didn't work out and am still amazed the first one did.

    Rights come with responsibilities, and until an animal can understand, acknowledge, and agree to respect both the rights and responsibilities, it doesn't get either. The whales have no more rights than the fish they eat. So the logical end to PETA's question is the extermination of all carnivores.

    PETA is one of the nuttiest organizations I've ever encountered.

    PETA likes to act so holier than thou, but they actually kill animals (PETA and Euthanasia - The Daily Beast) (Better dead than fed, PETA says). Thus, they don't really have any respect from me.

    In seriousness though, this was one pretty dumb lawsuit. I'm glad the judge had common sense to dismiss it.
