SAN DIEGO (AP) — An effort to free whales from SeaWorld by claiming they were enslaved made a splash in the news but flopped in court Wednesday.

A federal judge in San Diego dismissed an unprecedented lawsuit seeking to grant constitutional protection against slavery to a group of orcas that perform at SeaWorld parks, saying the 13th amendment applies only to humans.

U.S. District Judge Jeffrey Miller stopped the case from proceeding two days after he became the first judge in U.S. history to listen to arguments in court over the possibility of granting constitutional rights for members of an animal species.

Wow, a California judge with a brain.

Getting constitutional rights for animals is all about future litigation. If they accomplish that, they'll be able to sue for all kinds of things. PeTA is nothing more than money-grubbing lawayers. They don't give a wit about animals. I'm pleased that the judge shut the door on them.

I can see their position. If the courts are willing to give a paper entity Free Speech rights then it would be a good time to try animal rights as well. I'm glad this one didn't work out and am still amazed the first one did.

Rights come with responsibilities, and until an animal can understand, acknowledge, and agree to respect both the rights and responsibilities, it doesn't get either. The whales have no more rights than the fish they eat. So the logical end to PETA's question is the extermination of all carnivores.

PETA is one of the nuttiest organizations I've ever encountered.

The judge should have laughed his ass of at PETA and fined the **** out of them and their lawyers for wasting the court's time and tax payer's money.

Yeah only corporations are people. :lamo

In seriousness though, this was one pretty dumb lawsuit. I'm glad the judge had common sense to dismiss it.

How long until swatting a fly is an act of murder?

PETA should be responsible for all costs associated with this rediculous trial.

Corporations are a peaceful assembly of people and as such have constitutional rights.

Yes, but corporations are not people.

PETA should be held responsible for all court costs IMO.

Corporations are a peaceful assembly of people and as such have constitutional rights.

That's fine for the people. The people have rights. The assembly, in and of itself, should not.

How long until swatting a fly is an act of murder?

Meat is murder! And murder is delicious...

Corporations are a peaceful assembly of people and as such have constitutional rights.
Then the next time a corporation is convicted of a crime we should issue arrest warrants for all of those peacefully assembled people that have voting shares.

Of course. If they commit a crime then they are no longer peaceful assembly of people.Just like protesters who riot and damage property.

An assembly of people are people. So your statement is ridiculous. The 1st amendment doesn't give you a one at a time clause. You can exercise any right in the 1st amendment one at a time, two at a time or all at once.

That would stopp many of the frivelous lawsuits. When someone comes in with a lawsuit so bogus or so undeniably false, they should have to pay the court fees.

Meat is not murder, because murder is an illegal act. Killing for food is not illegal.

The organization encourages women to strip naked in protest of wearing animal fur, so I'm willing to accept a bit of crazy.

The problem with PETA is they do not help animals. They raise money claiming they do.

LOL! So they're protected until they commit a crime ... then the status changes and they're not responsible for the crime. That sounds about right. LOL!
