federal appeals panel in San Francisco ruled Tuesday that California’s ban on same-sex marriage violates the constitutional right to equal protection.
The panel overturned Proposition 8, which was approved by 52 percent of the state’s voters in 2008 and amended the state’s constitution to limit marriage to a man and a woman.

The court’s decision upheld a 2010 decision by former Judge R. Vaughn Walker that found marriage to be a fundamental right protected by the Constitution, and that the proposition “fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license.”

I honestly, am pretty happy about this and I believe now that we have this ruling, we will see something done at the federal level.
 
I'm happy as well, but they still have to face the Supreme Court. I am not hopeful about that.

It wasn't the Surpreme Court. Our convo on facebook re-angered me and I wrote the wrong title. Two days later, the Pats loss is still screwing with my head.

Hey, SCOTUS or federal appeals...equal protection is still equal protection. And it takes us one step closer to a SCOTUS ruling.

I imagine they will rule the same. I then imagine they will find for Kody Brown.
