They are innocent until proven guilty. They will get the chance to make their case.
But no, if they are accessories to one crime, it does not absolve them because they weren't in another. That's sort of the arguement used in The Godfather to make the family a little more likeable.
Their case is already proven by what they are accused of not actually being illegal. This whole case is bunk. The entire complaint is nonsense and outrage, all the while admitting that they are complying with DMCA and even going above and beyond.
Did anyone else notice that this case includes sites like Paypal and internet poker sites as defendants? This charge is so overreaching it's embarrassing.
The only thing the complaint actually manages to prove is that these guys owned and operated a successful storage site, made a profit from doing so, and that some people used it to infringe on copyright. But it has already been settled that a hosting site is not responsible for policing its users. As long as it complies with DMCA notices, which Megaupload did, it has done nothing wrong.
These folks have been arrested for something that is not actually a crime. I cannot stress this enough.
