    Owner of car dealership labeled "Taliban Toyota" wins millions

    The owner of a large southwest Alabama car dealership derided as "Taliban Toyota" by a competitor has been awarded $7.5 million in damages after a jury trial for his slander claim. Iranian-born Shawn Esfahani, owner of Eastern Shore Toyota in Daphne, Alabama, sought $28 million in compensatory and punitive damages from Bob Tyler Toyota, claiming employees at that Pensacola, Florida-based dealership falsely portrayed him as an Islamist militant to customers.

    Slander is difficult to prove. Judges roll their eyes and juries presume some thin-skinned bastard is trying to be greedy. This must have really been a vicious assault, that cost him beaucoup dollars in profit... and he could prove it. Good for him.

    the jury correctly found for the plaintiff but the award is far too high. It should be reduced by several million on appeal.

    I don't know about that TD, dealership owners make a lot of money and if his sales were that badly damaged I'd say this is one of the few large suits I actually agree with.
    Neither side in an argument can find the truth when both make an absolute claim on it.

    I imagine the judges would look at the size of the business and what is reasonably expected as a loss, right?

    Not always but in this case you can actually make a claim for millions of losses in my opinion. Toyota is a hot selling item, the dealer near him went on a campaign of attacking his character and was well within range to benefit for the attacks. If the dealer who was attacked can prove his sales were down and the other one's sales were up after the campaign by a decent margin a couple million a year in loss is not all that unimaginable and the reputation loss is immeasurable in the long term, it takes time and money to hopefully get your good name back. I'll say this, in my area there are probably about 10 major dealers and none of the owners are starving even with all the competition. Usually I think big judgements are meritless but in this particular one I'm not so sure about that.
