A Bronx man was viciously assaulted and robbed on a subway train Sunday by four men who he says taunted him for being white.

"People started saying stupid little comments - cracker this, white boy this, f----t this," Fordell said. "I told them the only reason they were saying this is there was four of them and one of me."

The case is being investigated by detectives, but has not been assigned to the NYPD hate crimes task force because cops are unsure if the suspects were motivated by bias, sources said.

"They have to look at whether that was the motivation before the robbery," a police source said.

I don't like "Hate crime" legislation as a general rule. A crime is a crime is a crime. However, here is a case that common sense says "Yeah, race mattered here". Sad really this requires "investigation"

It wouldn't be the first hate crime against a white successfully prosecuted. I support (US, not Euro-free-speech-restrictions) hate crime legislation; hate crime is terrorism and requires more severe action. If the accused are members of a white-hate group or white-hate literature is discovered in their background (that's the investigation required, Vic), nail the damn terrorists.

"Yeah, race matered here" is not enough. It must be the clear (physical evidenced) motivation of the crime. Calling someone the n-word and then punching them does not qualify as a hate crime. It's amazing how many people don't understand US hate crime legislation; it's short and clear.

Me and about 10 of my friends took a shortcut up broadway to the GWB cause the Henry hudson was jammed..... well it was jammed because we ended up driving through the Washington heights riots...

we were in early 70's jeeps with no tops and windshields folded down... :shock:

It's bad - generally speaking anytime someone is harassed adn beaten is bad. It is not *more bad* because he was white and *maybe* it was racially charged - because that belief (which is what hate crime legislation does) makes it worse to be beaten (or not as bad) depending on WHY the attack happened.

If someone attacked me and I don't know the motive - that hsould be no different than if they called me a certain name. Anyone - regardless of motive - should receive equal punishment.

Somewhere out there is someone who was attacked as well - in the same way - but the assailants just didn't psit out a few hateful slurs and *therefor* those assailants got off a little lighter.

Should they? Shouldn't everyone be punished equally for the ACTION of their crime - not their THOUGHT process?

US hate crime legislation is based in motivation. In the case of US hate crime, there must be clear evidence that the accused is attempting to terrorize a group of people. The crime is not entirely personal, but part of an organized hate machine intent on bringing fear to a group. The prosecuter must prove that the accused is part of such an organization, attends such things or has such literature for a hate crime conviction. Context goes beyond the criminal act itself.

You are another person who didn't understand US hate crime legislation. Laugh away, smartie.

It's no different than 1st and 2nd degree murder. And a US hate crime conviction is tantamount to terrorism.

I went to Pratt and lived in the 'hood at the time. It is surprising a wonder bread kid like me only gotten beaten up once and mugged twice living in Ft Greene at the time.

The riot was that Yusuf Hawkins deal. And **** I don't even look Italian.

What do you mean, "sadly"? Are you asking for a summary verdict here without knowing the facts of what happened? Your argument is weak.

Hate crime laws would apply just as equally to this case as it would any other if the facts stick.

But I guess burden of proof and "innocent until proven guilty" don't matter to you.

One CC permit and a nice load of 9 or so 9mm hydroshok rounds would have ended that confrontation immediately. It would have also put 4 racist thugs where they belong, laying on the ground in a puddle of blood. I promise if 4 people come at me that is AUTOMATICALLY self defense for fear of death and deadly force will be used. Without a second of hesitation because I may not have a second.

Same rule would apply for a black man with 4 white dudes, hispanic dude with 4 blacks, doesn't matter. 4 on 1 isn't a fight, it's survival.

I think this was less about him being white and more about being different and smaller than his attackers. 4 guys looking for trouble will target whoever then think with give them the least resistance. He just happened to be the unlucky fellow there at the time.

Intimidation is usually the first step...

I'm Vic's defense, he didn't understand hate crime legislation. If he read my posts above, maybe now he does. The investigation is not about what they said, it's about their background. Background proof, evidence beyond the immediate context, is required for a hate crime prosecution/conviction.

I think, evenly armed, the playing field is heavily in my favor. The person(s) committing the forcible felony, against which I can use deadly force anywhere I can legally carry (Florida SYG Law), probably doesn't know I'm armed. He looks the wrong way, he's dead. They give me a second, I'll pop three of four and if they scatter I might keep firing. How you like that bravado, leg; think you can roll wit me? Can you at least see wtf I'm talkn bout and stop that ignorant crap?

Exactly. I'm always dumbfounded how some pretend that having a gun gives you immunity in a crime. Guess what? People with guns get killed too.
