U.N. asks Texas to commute Mexican's death sentence

If the United States signs and ratifies a treaty, it is legally obligated to abide by that treaty. This is a basic tenant of international law. The U.S. insists other states abide by this treaty, it should as well.

This is the second time this matter has reached the Supreme Court. Medellin, a citizen of Mexico, was convicted of capital murder in Texas state court and sentenced to death. Medellin filed a petition for a writ of habeas corpus arguing that the state violated his rights as a foreign national to consular access under the Vienna Convention. His petition was denied in the lower courts, despite a ruling by the International Court of Justice that Medellin and others were entitled to review of their convictions based on violations of the Vienna Convention. While Medellin's case was pending in the United States Supreme Court, the Bush administration filed a brief urging the Court to rule that Medellin had no private right to seek enforcement of the Convention, but also announced that the U.S. Government would comply with the World Court decision and directed state courts to reexamine the claims of Medellin and other Mexican nationals. Accordingly, Medellin filed a new state habeas petition and asked the Supreme Court to stay its consideration of the case pending state review. The Supreme Court in a 5-4 decision dismissed Medellin’s petition and allow the state habeas case to go forward. Medellin v. Dretke.
The Texas Court of Criminal Appeals denied Medellin's habeas petition because Medellin had not raised the issue at his trial, as required by Texas law. It held that the International Court of Justice decision was not binding federal law and, thus, did not preempt the state procedural rule requiring petitioners to raise issues at trial, and furthermore, that under the separation of powers doctrine, President Bush had no authority to order the state to reconsider Medellin's conviction.

Then China and other nations can say "Screw the US, let's execute the American without due process", and of course, the American is then denied his rights. It's a slippery slope. What's next? No more international treaties against genocide? No more international treaties against dictators who commit mass murder against their own people? When it comes to international treaties, you cannot pick and choose, out of convenience, which ones to obey. When you break just one, you might as well just break them all, because the rule of law then no longer matters.

At this point the only right we should be concerned with is this piece of human excrements right to die. The sooner the better. The idea anyone should apologize to Mexico is laughable. The only one owed an apology is the victim's loved ones. The only one w ho owes the victim's loved ones an appology is the murderer for doing the deed and the US government for not doing its damn job to secure the border and crack down on illegals which resulted in this scumbag being able to be in the country in the first place. The only safeguard that should be in place is the government actually doing its damn job to secure the border and get rid of illegals.

When I said apologize, I meant have some under secretary in the state dept fire off a gratuitous Blah Blah letter to the Mexican Consulate.

Article 36. Foreign nationals who are arrested or detained be given notice "without delay" of their right to have their embassy or consulate notified of that arrest. If the detained foreign national so requests, the police must fax that notice to the embassy or consulate, which can then check up on the person. The notice to the consulate can be as simple as a fax, giving the person's name, the place of arrest, and, if possible, something about the reason for the arrest or detention.

Did the convicted man ask? Can he prove it? What about his lawyer? Did he ask? If he did ask or told his lawyer he did, why didn't his lawyer go public with the request when it wasn't filled?
 
I say don't execute him, keep him alive. At least for some bands like Rage, and or, Santana to take up his cause, distort the case, and make some decent music again.

So of all the murders that Mexican citizens will commit within mexicos borders today, whether it be petty criminals in mexico city, right up to gang runners in the north, does Mexico seriously have nothing better to do, then worry about this one guy?

I mean, it's up to a countries government to protect their citizens sure, but if the guys guilty of rape and murder... With all of mexicos problems, the government should really back down on this one.

I live in AZ now, and we don't like rapists or murderers or drug and human smugglers from foreign countries, either. That's not necessarily true. Look, I totally agree that the Mexican Consulate should have been contacted, but this guy is a rapist and murderer. If he is executed, I won't lose any sleep over it. I only believe that we should do it right next time, for the sake of American citizens overseas. As for smelling bad, you got me dead to rights on that one. LOL.

Excuse me for a minute, while I go get a banana. :mrgreen:
