ICC issues Gaddafi arrest warrant

Libyan leader, his son Saif al-Islam and his spy chief Abdullah Senussi indicted for crimes against humanity.

The International Criminal Court has issued arrest warrants for the Libyan leader Muammar Gaddafi, his son and his spy chief, citing evidence of crimes against humanity committed against political opponents.

Judge Sanji Mmasenono Monageng announced the decision on behalf of a three-judge panel in The Hague on Monday, saying the warrants were meant to force Gaddafi and his two confidantes to appear before the court and prevent the possibility of a cover-up.

It was the second time in the ICC's nine-year history that it issued an arrest warrant for a sitting head of state. The ICC indicted the Sudanese president, Omar al-Bashir, in 2009, though he has yet to be arrested.

"State policy was designed at the highest level of the state machinery, and aimed at quelling by any means, including by the use of lethal force, demonstrations of civilians against the regime of Muammar Muhammad Gaddafi," Monageng said.

This is a good question.
But the fact that he is warned by the ICC is a major plus...

I'm guessing that Gadaffi doesn't give a rat's patooty what the ICC warns him of.
 
The ICC ruling will be a useful tool to deflect criticism if Gadaffi gets killed. International legitimacy is hardly a requirement, but it is nice to have when you can get it.
 
An ICC warrant is pretty much meaningless at this point.

Hell every Country that might have the power to do something about this is so cash strapped nothing more than than the now token air strikes is going to happen.

Obama might use this as another justification for ignoring the War Powers Act, but that's about it.

Who makes arrests for the ICC? It's pretty hard to say how they have legitimate authority over sovereign nations.
 
I'm not comfortable with the ICC indicting the current leaders of sovereign nations, ESPECIALLY in a place like Libya where there is a power struggle taking place, and the regime is unstable. This will make it much more difficult for Gaddafi to abdicate and flee to another country, which is an outcome that the United States should fully support. A lot of dictators are willing to give up power if they have a guarantee of asylum in a friendly country...but spending the rest of their life in a prison cell in The Hague is a lot less attractive of an alternative to fighting to retain power.

IMO, Western nations should fully support any other nation that is willing to give Gaddafi (or other nasty dictators) asylum, and not pursue the matter. If the goal of the ICC is to provide a deterrent for war crimes, this approach isn't effective because it gives national leaders a perverse incentive to commit even MORE war crimes.

Agreed.

Actually, Gadaffi is more worried about the fact that someone might knock on his door for removing the tag from his mattress that says *not to remove the tag from your mattress*.

The ICC is a bad idea and needs to be scrapped.
