WASHINGTON – The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth. The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election.

Donofrio says that since Obama had dual nationality at birth — his mother was American and his Kenyan father at the time was a British subject — he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.

At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that Obama was born in Kenya, not Hawaii as Obama says and Hawaii officials have confirmed.

Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have dismissed Berg's lawsuit. Federal courts in Ohio and Washington state have rejected similar lawsuits.

Allegations raised on the Internet say the birth certificate, showing that Obama was born in Hawaii on Aug. 4, 1961, is a fake.

But Hawaii Health Department Director Dr. Chiyome Fukino and the state's registrar of vital statistics, Alvin Onaka, say they checked health department records and have determined there's no doubt Obama was born in Hawaii.

Why don't some people get over it already. Obama's mother should just show her passport and prove she had never been to Kenya - however, the accusations are so rediculous that she really shouldn't have to.

Besides, even if he WERE born in Kenya, he still would have been a natural born citizen though his mother.

People were going around saying Bush went AWOL,Bush stole the elections, Bush masterminded the 9-11 attacks, or Bush lied to get us into Iraq(even though everyone and their mom said Saddam had WMDs and this was even before Bush was in office,Saddam wouldn't let anyone inspect certain sites they wanted too when they wanted too,Saddam led everyone to believe he had WMDs and Saddam has a history of using WMDs)

It is becoming more clear that all the attacks against Bush saying he was selected actually caused a lot of damage to our military and helped our enemies.

It does nobody any good when people don't accept the legitimacy of the president. This needs to be settled now.

If wackos do not want to accept the legitimacy of someone's presidency then no amount of logic will persuade them. One only has to look at he die hard Bush bashers to see that is true. It has been settled,he posted a copy of his birth certificate on the internet for everyone and their mom to see, I am pretty sure that no other presidential candidate has done that. A Hawaii official said they have Obama's birth certificate.

When you have one fruitcake running around saying he has daul citizenship, another fruitcake saying he was born in Kenya and another fruitcake or even the same man saying even if he was born in the US his birth right citizenship was forfeited sometime in Indonesia. One has to wonder about the legitimacy of their claims.

I have no doubt that if Obama showed a copy of his original vault birth "certificate" , not his record of live birth, that that would be the end of it. Nobody can dispute an original birth certificate that was created the day he was born.

That would NOT be the end of it. People like yourself will never be convinced regardless of what evidence is presented. Even if he presented his original birth certificate (if he even has access to it) you'd find some reason to claim that maybe it's fraudulent, and he'll have to do X, Y, and Z before you're satisfied. Then if he did X, Y, and Z, you'll still say that maybe that isn't enough and he'll also have to do A, B, and C before you're satisfied.

Why should he waste his time indulging your conspiracy theories at all? I'm sure he has better things to do.
