Just so you all know, I have no problem with gay marriage. I'm not a supporter of it, but you won't see me lining up to vote against it either. I do believe it is a state issue and not a federal issue. If Californian's want to legalize gay marriage, I'm OK with that. But the fact remains that they did vote on it and the judicial system has taken the will of the voters and trampled on it. No one's rights are being taken away if gays can't marry. I believe too much is being made of this issue for there are several issues far more important in the grand scheme, but I can see why gays hold this issue near and dear to their heart, just as I hold protecting our children from predators, rapists and pedophiles near and dear to mine. If the law needs to be changed, then change it. Abusing the court system and it's intent for something like this would make our founding fathers cringe, especially since it overrides the will of the people in the state.
So if California votes against outlawing gay marriage in November, I assume that you'll be perfectly alright with accepting it, then? Cool.

And BTW, a majority of Californians already supported and voted last year. Of course an activist judge put a stop to that because we can't have the will of the people ruling the land, that would be undemocratic.
The will of the people also led to jim crow laws, so please, forgive me for saying **** you to laws that discriminate.

The justices are to determine what is and what is not constitutional. The former ban on gay marriage was unconstitutional according to California state law. Any other such ruling by the justices would've been "legislation from the bench".
