Ga. Boys Ages 8 and 9 Charged With Rape

ACWORTH, Ga. (AP) — Three boys, ages 8 and 9, were being held Monday in a detention center on charges of kidnapping and raping an 11-year-old girl near a suburban apartment complex, officials said.

The alleged attack happened Thursday and the girl's mother reported it to authorities Sunday, Acworth police Capt. Wayne Dennard said.

"The victim said they were playing outdoors and the girl was forced into a wooded area where she was sexually assaulted, where one of the boys raped her," Dennard told The Associated Press.

The three boys — an 8-year-old and two 9-year-olds — appeared in juvenile court Monday afternoon, dwarfed by the courtroom chairs and wearing navy blue jump suits and shackles. Their names were withheld because of their age.

Cobb County District Attorney Pat Head said the boys could not be charged with felony crimes because of their age but could be tried for alleged delinquent acts that could place them in a juvenile facility for up to five years.

The next step will be for the court to schedule a hearing to determine how to proceed in the case, Head said.

Juvenile Court Judge A. Gregory Poole issued a gag order preventing the lawyers from commenting further.

Acworth Police Chief Mike Wilkie said one of the boys was accused of threatening to hit the girl with a rock before the alleged assault. Wilkie also said the investigation is "far from over," and investigators are looking into claims that after the alleged attack, the girl talked about it with her friends at a slumber party.

The case involves children from a working class apartment complex. Acworth, 30 miles northwest of Atlanta along the shores of Lake Allatoona, is a town of about 17,000.

Acworth police said their department has never before investigated allegations of rape where all the parties were this young. "This wouldn't be normal anywhere, but especially not Acworth," Dennard said.

Where the father of one of the accused boys was also interviewed, and says the following:

The father of one of the boys said his son is being accused of luring the girl into the woods.

"He's only 45 inches, 40 pounds in the third grade," the boy's father said. "This girl's in the fifth grade, she's 11 years old, 2 foot taller than him. How can my boy with a broken wrist be accused of any kidnapping charge?"

The boy's father said he believes she made up the story to cover up her promiscuity.

"She's trying to cover her own butt by getting everyone else in more serious trouble," the boy's father said. "I guess we're just going to have to see how this is going to unfold."


In a way, he's got a point. Girls are a lot bigger and more mature than boys at that age, and an 11-year-old girl is a lot bigger and more mature than an 8-year-old boy, and probably much stronger than an 8-year-old boy with his arm in a cast. If it's true this boy is only 40 pounds, he is tiny. I was 45 pounds at 9 years old, and my dad took me to the doctor to find out why I wasn't growing. 40 pounds is small. It's hard to believe a 40 pound child barely over 3 and a half feet tall could rape anyone, let alone kidnap someone, at least not without a weapon. I don't know the size of this particular girl, but I know that nearly any 11-year-old girl has a size advantage over the average 11-year-old boy, let along an 8-year-old.
Also, I have personally known many sexually active 11-year-olds both male and female (especially female). But I have not known any 8 year olds who were sexually active... at least not by choice.

On the other hand, there were three of them. I suppose they could've overpowered one 11-year-old girl... or even an adult, if they put their minds to it.

It's hard to say.
My instinct is to always believe the victim in a sexual assault case. But 8-year-old rapists attacking a much older and larger girl (who was apparently 5 and a half feet tall, so, you know... basically the size of an adult) just seems so unlikely. I think about how my boys were at 8- still playing with Star Wars action figures. It just seems unfeasible, I don't know.
On the other hand, I've known many 11-year-old girls who were already two years past puberty, as big as grown women, and involved in consensual sexual relationships with older teen boyfriends.

I'm not making any assumptions in this case.
It seems to me just as likely to be one way as another- or to put it another way, both scenarios seem equally unlikely and bizarre.
I hope whatever the truth of the matter is, it comes out.

It is worth noting that these are not poverty-stricken inner-city street kids (in case anyone is jumping to that conclusion). They are working-class suburbanites.

I have a terrible aversion, on the one hand, to this father implying that the alleged 11-year-old victim was some sort of promiscuous slut who asked for it.
On the other hand, if his words are true- a child that small, and with a broken wrist, a "victim" much older and larger- it does make an inescapable sort of sense, what he's saying.

I wonder if the girl was mentally retarded, or otherwise handicapped in some way (but wouldn't the articles have mentioned it?).
That would make this whole thing a little more feasible.

Football players charged with raping a retarded classmate, even though she kinda-sorta consented (but being retarded, the court found that her "consent" didn't really count)?

I saw this in the Washington Post this morning. The father of one of the kids said that the little girl didn't claim rape until her parents found out she had had sex. If the boys (or boy) did rape her, what the hell is up with that? How could this happen? The kid(s) should at least serve some time at a detention center. If the girl is lying, she should be penalized big-time.

I didn't know what intercourse was until I was in the 5th grade, and even then, I doubt I would even have known how things "fit."
