It was supposed to be an epic battle over the fate of Roe v. Wade.
Next week, the Supreme Court hears oral arguments in Whole Woman’s Health v. Hellerstedt, a challenge to Texas’s ambitious anti-abortion law HB2. If this law is upheld — a very real possibility in a conservative Supreme Court — Roe v. Wade would have most likely remained alive in name only. States would gain sweeping new power to shut down abortion clinics, so long as they dressed up the laws they enacted to end access to abortion as health regulations.
Except that opponents of abortion no longer have the fifth vote they need to gut Roe. Justice Antonin Scalia’s death means that Roe shall live at least another year. Whether it survives past next year, however, could very well be decided by whoever gets to fill Scalia’s seat.

I was wondering how this would get by the Supreme Court with Scalia there, but you could be right on this being even worse off with an arguably divided 4-4 condition.

and the Republicans have already vowed not to approve anyone that Obama might nominate to the SCOTUS regardless of who it is, so it looks like the new president will name Scalia's successor.

So, a Cruz nominee or a Rubio nominee could tip court against Roe v Wade. A Trump nominee, who knows? Trump is pro choice, pro life, interchangeably.

How can you be so sure? The Congress is very adept at seeing to it that nothing is done.

Politically I think they can, and they will give the social conservatives rush.....but it will piss off the moderates, the undecides...who may not have decided even to go to the polls.....they will realize the games that are going to be played in the future. It probably will send a few Senators home when the time comes.

Yeah, I think they can get away with it. But I am positive they may not like what they created.

Could happen, but first the Republicans have to be successful in blocking Obama's nominee, and Hillary has to succeed in being elected.

Oh, and then Obama will have to be approved by Congress. So far, the Republicans at least have opposed everything that Obama has proposed.

Yeah, I think they can get away with it. But I am positive they may not like what they created.

Any Republican that votes for an Obama nominee will not be re-elected. It is that simple.

That being said, most voters are oblivious to the Supreme Court. 2/3 of the electorate couldn't name 1 Supreme Court judge past or present. If you can name all 8 current Justice's you are part of the 1%.

There should be a mechanism in place where the president can bypass Senate approval when the senate shows it is acting like a petulant child and obstructing an appointment without just cause.

Any Republican that votes for an Obama nominee will not be re-elected. It is that simple. .

If it is really that simple, matter how qualified the nominee, what you suggest is that those Republicans are narrow-minded jerks.

We already know what type of judge Obama is going to nominate. A tiger does not change it's stripes.
